The Title Conditions (Scotland) Act 2003 (Rural Housing Bodies) Amendment Order 2013

Coming into force
The Scottish Ministers make the following Order in exercise of the powers conferred by section 43(5) and (8) of the Title Conditions (Scotland) Act 20031 and all other powers enabling them to do so.

They are satisfied as to the matters mentioned in section 43(6) of that Act.

Citation and commencement1.

This Order may be cited as the Title Conditions (Scotland) Act 2003 (Rural Housing Bodies) Amendment Order 2013 and comes into force on 14th May 2013.

Amendment of the list of prescribed rural housing bodies2.

(1)

The Schedule to the Title Conditions (Scotland) Act 2003 (Rural Housing Bodies) Order 20042 (rural housing bodies prescribed under section 43(5) of the Title Conditions (Scotland) Act 2003) is amended as follows.

Insert in the appropriate place, according to alphabetical order, the following bodies:—

  • Down to Earth Solutions Community Interest Company; and

  • West Harris Trust.

Omit “Down to Earth Scottish Sustainable Self Build Housing Association Limited”3.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order makes amendments to the list of prescribed rural bodies in the Title Conditions (Scotland) Act 2003 (Rural Housing Bodies) Order 2004. “Down to Earth Scottish Sustainable Self Build Housing Association Limited” is replaced with “Down to Earth Solutions Community Interest Company” due to the body changing its name and one new body, West Harris Trust, is added. Rural housing bodies are bodies in favour of whom it is competent to create a rural housing burden comprising a right of pre-emption under section 43(1) of the Title Conditions (Scotland) Act 2003.
