class="schGroup7" eId="d25e495"><heading>Interpretation</heading><paragraph eId="schedule-2-paragraph-1" class="schProv1"><num>1.</num><intro><p>In this Schedule—</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr>” means the Housing (Scotland) Act 2001<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00013" href="http://www.legislation.gov.uk/id/asp/2001/10">2001 asp<span ukl:Name="NonBreakingSpace"> </span>10</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>” means the Housing (Scotland) Act 2010; and</p></content></hcontainer><hcontainer name="definition"><content><p>“the appointed day” means 1st April 2012.</p></content></hcontainer></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e526"><heading>Registration of social landlords</heading><paragraph eId="schedule-2-paragraph-2" class="schProv1"><num>2.</num><subparagraph eId="schedule-2-paragraph-2-1"><num>(1)</num><content><p>Any application for registration under section 59 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> which is made, but not determined, before the appointed day is, on and after that day, to be treated as an application to the Regulator for inclusion in the register kept under section 20 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-2-2"><num>(2)</num><content><p>The Regulator, before determining the application, may require the applicant to provide such further information as the Regulator may request.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e552"><heading/><paragraph eId="schedule-2-paragraph-3" class="schProv1"><num>3.</num><content><p>Any request to the Scottish Ministers under section 60(4) of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> which is made, but not determined, before the appointed day is, on and after that day, to be treated as a request made to the Regulator under section 28(2) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e567"><heading/><paragraph eId="schedule-2-paragraph-4" class="schProv1"><num>4.</num><subparagraph eId="schedule-2-paragraph-4-1"><num>(1)</num><content><p>This paragraph applies to any decision which, immediately before the appointed day, is appealable under section 62 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr>.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-4-2"><num>(2)</num><intro><p>Section 62 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> is to continue to have effect in respect of an appeal against a decision to which this paragraph applies which is brought, but not determined, before the appointed day except that, on and after that day—</p></intro><level class="para1" eId="schedule-2-paragraph-4-2-a"><num>(a)</num><intro><p>the decision appealed against is to be treated as having been made—</p></intro><level class="para2" eId="schedule-2-paragraph-4-2-a-i"><num>(i)</num><content><p>by the Regulator rather than by the Scottish Ministers; and</p></content></level><level class="para2" eId="schedule-2-paragraph-4-2-a-ii"><num>(ii)</num><content><p>in relation to the register kept under section 20 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> rather than in relation to the register maintained under section 57 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr>; and</p></content></level></level><level class="para1" eId="schedule-2-paragraph-4-2-b"><num>(b)</num><content><p>anything done by or in relation to the Scottish Ministers in respect of the appeal before the appointed day is to be regarded as having been done by or in relation to the Regulator.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-4-3"><num>(3)</num><intro><p>Where an appeal against a decision to which this paragraph applies has not been brought before the appointed day—</p></intro><level class="para1" eId="schedule-2-paragraph-4-3-a"><num>(a)</num><intro><p>the decision is, on and after that day, to be to be treated as having been made—</p></intro><level class="para2" eId="schedule-2-paragraph-4-3-a-i"><num>(i)</num><content><p>by the Regulator rather than by the Scottish Ministers; and</p></content></level><level class="para2" eId="schedule-2-paragraph-4-3-a-ii"><num>(ii)</num><content><p>in relation to the register kept under section 20 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> rather than in relation to the register maintained under section 57 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr>;</p></content></level></level><level class="para1" eId="schedule-2-paragraph-4-3-b"><num>(b)</num><content><p>the body concerned is accordingly entitled to appeal against the decision under section 29(1) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>; and</p></content></level><level class="para1" eId="schedule-2-paragraph-4-3-c"><num>(c)</num><content><p>where an appeal is subsequently made against a decision to remove the body from the register, section 29(3) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> applies.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-4-4"><num>(4)</num><content><p>Sub-paragraph (3) does not allow any appeal to be made which could not have been made under section 62 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> had that section continued to have effect in respect of the decision concerned.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e679"><heading>Inspections and inquiries</heading><paragraph eId="schedule-2-paragraph-5" class="schProv1"><num>5.</num><intro><p>Where an inspection under section 69 or 72 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> has been, or is being, carried out before the appointed day, on and after that day—</p></intro><level class="para1" eId="schedule-2-paragraph-5-a"><num>(a)</num><content><p>where the inspection is not completed before the appointed day, section 69 or, as the case may be, 72 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> is to continue to apply in relation to the inspection except that anything done by or in relation to the Scottish Ministers before the appointed day in relation to the inspection (including the appointment of the inspector) is to be regarded as having been done by or in relation to the Regulator; and</p></content></level><level class="para1" eId="schedule-2-paragraph-5-b"><num>(b)</num><content><p>section 70 or, as the case may be, 73 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> is (in so far as not complied with before the appointed day) to continue to apply in relation to the inspection except that the reference in the relevant section to the Scottish Ministers is to be treated as a reference to the Regulator.</p></content></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e710"><heading/><paragraph eId="schedule-2-paragraph-6" class="schProv1"><num>6.</num><subparagraph eId="schedule-2-paragraph-6-1"><num>(1)</num><content><p>Any inquiry or audit which has been carried out before the appointed day under paragraph 16 or 17 of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> is, on and after that day, to be treated as inquiries which have been made under section 42 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-6-2"><num>(2)</num><intro><p>Where any such inquiry or audit is being carried out immediately before the appointed day, on and after that day—</p></intro><level class="para1" eId="schedule-2-paragraph-6-2-a"><num>(a)</num><content><p>the inquiry or audit may be continued as inquiries made under section 42 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>;</p></content></level><level class="para1" eId="schedule-2-paragraph-6-2-b"><num>(b)</num><content><p>paragraph 16 of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> is to continue to have effect in respect of any requirement made under that paragraph before the appointed day (except that the requirement is to be treated as having been made by the Regulator or a person appointed by it when making inquiries under section 42 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>); and</p></content></level><level class="para1" eId="schedule-2-paragraph-6-2-c"><num>(c)</num><content><p>anything else done by or in relation to the Scottish Ministers or the person carrying out the inquiry or audit before the appointed day is to be treated as having been done by or in relation to the Regulator or a person appointed by it when making inquiries under section<span ukl:Name="NonBreakingSpace"> </span>42 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e767"><heading>Powers to obtain information</heading><paragraph eId="schedule-2-paragraph-7" class="schProv1"><num>7.</num><content><p>Any notice served by the Scottish Ministers under section 77 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day is, on and after that day, to be treated as requiring information or documents to be provided or produced to the Regulator rather than to the Scottish Ministers or a person authorised by them.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e780"><heading>Regulatory interventions</heading><paragraph eId="schedule-2-paragraph-8" class="schProv1"><num>8.</num><content><p>Any appointment or requirement made, and any direction given, by the Scottish Ministers under section 71 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day is, on and after that day, to be treated as having been made or given by the Regulator under section 58(2) or, as the case may be, section<span ukl:Name="NonBreakingSpace"> </span>59(4) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e798"><heading/><paragraph eId="schedule-2-paragraph-9" class="schProv1"><num>9.</num><subparagraph eId="schedule-2-paragraph-9-1"><num>(1)</num><intro><p>Where a person is removed under paragraph 4(1) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day, on and after that day—</p></intro><level class="para1" eId="schedule-2-paragraph-9-1-a"><num>(a)</num><content><p>paragraph 4(5) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> is to continue to have effect in relation to the removal; and</p></content></level><level class="para1" eId="schedule-2-paragraph-9-1-b"><num>(b)</num><content><p>the removal, and anything done by or in relation to the Scottish Ministers in relation to the removal before the appointed day (including anything done in respect of an appeal brought, but not determined, before that day), is to be treated as having been done by or in relation to the Regulator.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-9-2"><num>(2)</num><content><p>Where, before the appointed day, the Scottish Ministers have given a notice under paragraph<span ukl:Name="NonBreakingSpace"> </span>4(3) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> but have not yet removed the person to whom the notice relates, the notice is, on and after that day, to be treated as a notice given by the Regulator under section 60(2) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> of its intention to remove the person under section 60(1) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e846"><heading/><paragraph eId="schedule-2-paragraph-10" class="schProv1"><num>10.</num><subparagraph eId="schedule-2-paragraph-10-1"><num>(1)</num><content><p>This paragraph applies to any appointment made by the Scottish Ministers under paragraph 5 or 6 of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-10-2"><num>(2)</num><intro><p>On and after that day—</p></intro><level class="para1" eId="schedule-2-paragraph-10-2-a"><num>(a)</num><content><p>an appointment to which this paragraph applies is to be treated as having been made by the Regulator under section 65(1) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>, but</p></content></level><level class="para1" eId="schedule-2-paragraph-10-2-b"><num>(b)</num><content><p>the Regulator is not entitled to make a requirement under section 65(3) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> in relation to the person appointed.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e886"><heading/><paragraph eId="schedule-2-paragraph-11" class="schProv1"><num>11.</num><subparagraph eId="schedule-2-paragraph-11-1"><num>(1)</num><content><p>Any person removed by the Scottish Ministers under paragraph 18(1)(a) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day is, on and after the appointed day, to be treated as having been removed by the Regulator under section 62(1) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-11-2"><num>(2)</num><content><p>Where, before the appointed day, the Scottish Ministers have given a notice under paragraph 18(3) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> but have not yet removed the person concerned, the notice is, on and after that day, to be treated as a notice given by the Regulator under section 62(2) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> of its intention to remove the person under section 62(1) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-11-3"><num>(3)</num><content><p>Paragraph 18(5) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> is to continue to have effect in respect of an appeal against a removal which is brought, but not determined, before the appointed day except that, on and after that day, anything done by or in relation to the Scottish Ministers in respect of the appeal before the appointed day is to be treated as having been done by or in relation to the Regulator.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e930"><heading/><paragraph eId="schedule-2-paragraph-12" class="schProv1"><num>12.</num><subparagraph eId="schedule-2-paragraph-12-1"><num>(1)</num><content><p>Any suspension imposed under paragraph 18(1)(b) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> which has effect immediately before the appointed day is, on and after that day, to be treated as a suspension imposed by the Regulator under section 61(1) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-12-2"><num>(2)</num><intro><p>Where a suspension is so treated—</p></intro><level class="para1" eId="schedule-2-paragraph-12-2-a"><num>(a)</num><content><p>the day referred to in section 61(3)(b) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> is to be regarded as the day on which the suspension would have ceased to have effect under paragraph 18(1)(b) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr>; and</p></content></level><level class="para1" eId="schedule-2-paragraph-12-2-b"><num>(b)</num><content><p>any directions given by the Scottish Ministers under paragraph 18(6) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> in relation to the suspension before the appointed day are, on and after that day, to be treated as having been given by the Regulator under section 61(4) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-12-3"><num>(3)</num><content><p>Paragraph 18(5) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> is to continue to have effect in respect of an appeal against a suspension which is brought, but not determined, before the appointed day except that, on and after that day, anything done by or in relation to the Scottish Ministers in respect of the appeal before the appointed day is to be treated as having been done by or in relation to the Regulator.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e988"><heading/><paragraph eId="schedule-2-paragraph-13" class="schProv1"><num>13.</num><content><p>Any direction not to act without the approval of the Scottish Ministers which is given under paragraph 18(1)(c) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day is, on and after that day, to be treated as a direction not to so act without the Regulator’s consent given under section 66(2)(b) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading/><paragraph eId="schedule-2-paragraph-14" class="schProv1"><num>14.</num><content><p>Any restriction not to act without the approval of the Scottish Ministers which is made under paragraph 18(1)(d) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day is, on and after that day, to be treated as a direction not to so act without the Regulator’s consent given under section 66(2)(a) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1018"><heading/><paragraph eId="schedule-2-paragraph-15" class="schProv1"><num>15.</num><intro><p>Where the Scottish Ministers have given a direction under paragraph 19(1) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day, on and after that day—</p></intro><level class="para1" eId="schedule-2-paragraph-15-a"><num>(a)</num><content><p>the direction is to continue to have effect (but is to be treated as having been given by the Regulator rather than by the Scottish Ministers);</p></content></level><level class="para1" eId="schedule-2-paragraph-15-b"><num>(b)</num><content><p>paragraph 19(3) and (4) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> is to continue to have effect in relation to the direction (except that references in sub-paragraph (4) to the Scottish Ministers are to be treated as references to the Regulator); and</p></content></level><level class="para1" eId="schedule-2-paragraph-15-c"><num>(c)</num><content><p>anything done by or in relation to the Scottish Ministers before the appointed day in relation to the direction is to be regarded as having been done by or in relation to the Regulator.</p></content></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1051"><heading>Accounts and audit</heading><paragraph eId="schedule-2-paragraph-16" class="schProv1"><num>16.</num><subparagraph eId="schedule-2-paragraph-16-1"><num>(1)</num><content><p>Sections 69 to 71 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> do not to apply in relation to any accounting period of a registered social landlord beginning before the appointed day.</p></content></subparagraph><subparagraph practice</heading><paragraph eId="schedule-2-paragraph-17" class="schProv1"><num>17.</num><content><p>Any statement published by the Scottish Ministers under section 80 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day is, on and after that day, to continue to have effect until 30th<span ukl:Name="NonBreakingSpace"> </span>September 2012.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1104"><heading>Insolvency <abbr title="et cetera" xml:lang="la">etc.</abbr></heading><paragraph eId="schedule-2-paragraph-18" class="schProv1"><num>18.</num><intro><p>Where a moratorium is in place under paragraph 4 of schedule 8 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> immediately before the appointed day, on and after the appointed day—</p></intro><level class="para1" eId="schedule-2-paragraph-18-a"><num>(a)</num><content><p>the moratorium is to be treated as a moratorium under section 75(1) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> which is deemed for the purposes of sections 76(1) and 78(3)(a) of that Act to have <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> in relation to its power to make proposals under section 80(1) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>;</p></content></level><level class="para1" eId="schedule-2-paragraph-18-g"><num>(g)</num><content><p>where, immediately before the appointed day, a copy of proposals has been served by the Scottish Ministers on secured creditors in accordance with paragraph 6(5)(b) of schedule 8 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> but those proposals are not yet (Scotland) Act 2001 asp 10">2001 Act</abbr> are to be treated for the purposes of sections 83 to 90 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> as having been agreed under section 82(1) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> (with any amendments made before the appointed day under paragraph 7(5) of schedule 8 to the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> being regarded as having been modifications made under section 83 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>);</p></content></level><level class="para1" eId="schedule-2-paragraph-18-i"><num>(i)</num><content><p>where, before the appointed day, the Scottish Ministers have not yet complied with title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> apply in relation to them as if they were proposals agreed under section 82(1) or, as the case may be, modified under section 83(1) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>;</p></content></level><level class="para1" eId="schedule-2-paragraph-18-j"><num>(j)</num><content><p>any manager appointed by the Scottish Ministers under paragraph 8(1) or (5) of schedule 8 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day is to be treated as having been appointed by the Regulator under section 85(1) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>;</p></content></level><level class="para1" Session in pursuance of paragraph 8(4) of schedule 8 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day are to be treated as having been given in pursuance of section 85(3) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> (and any application for directions under said paragraph 8(4) which is made but not determined before the appointed day is to be treated as an application for directions under said section 85(3));</p></content></level><level class="para1" eId="schedule-2-paragraph-18-m"><num>(m)</num><content><p>paragraph 12 of schedule 8 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> continues to have effect in respect of any application to the Court of Session under that paragraph which is made but not determined before the appointed day (except that anything done by or in relation to the Scottish Ministers in respect of such an application, including the making of such an application, before the appointed day is to be regarded as having been done by or in relation to the Regulator).</p></content></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1288"><heading>Organisational changes: notices and consents</heading><paragraph eId="schedule-2-paragraph-19" class="schProv1"><num>19.</num><subparagraph eId="schedule-2-paragraph-19-1"><num>(1)</num><content><p>Section 92 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> does not apply in relation to a change made before the appointed day in respect of which notice has been sent to the Scottish Ministers in accordance with paragraph 7(2) or 8(2) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr>.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-19-2"><num>(2)</num><intro><p>Where, before the appointed day, the Scottish Ministers give consent to an alteration or amendment under paragraph 7(3) or 8(3) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr>—</p></intro><level class="para1" eId="schedule-2-paragraph-19-2-a"><num>(a)</num><content><p>sections 93 to 95 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> do not apply in relation to the alteration or amendment, but</p></content></level><level class="para1" eId="schedule-2-paragraph-19-2-b"><num>(b)</num><content><p>where relevant, paragraph 7(4) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> continues to apply in relation to the consent.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1335"><heading/><paragraph eId="schedule-2-paragraph-20" class="schProv1"><num>20.</num><subparagraph eId="schedule-2-paragraph-20-1"><num>(1)</num><intro><p>Sub-paragraph (2) applies where a registered social landlord which is a registered society has, before the appointed day—</p></intro><level class="para1" eId="schedule-2-paragraph-20-1-a"><num>(a)</num><content><p>applied to the Scottish Ministers for consent for the purposes of paragraph 9 of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr>; or</p></content></level><level class="para1" eId="schedule-2-paragraph-20-1-b"><num>(b)</num><content><p>taken steps to consult tenants for the purposes of sub-paragraph (6) of that paragraph.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-20-2"><num>(2)</num><intro><p>Where this sub-paragraph applies, on and after the appointed day—</p></intro><level class="para1" eId="schedule-2-paragraph-20-2-a"><num>(a)</num><intro><p>sections 96 to 99 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> do not apply in relation to the matter to which the application or consultation relates but paragraph 9 of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> is to continue to apply in relation to that matter with the following modifications—</p></intro><level class="para2" eId="schedule-2-paragraph-20-2-a-i"><num>(i)</num><content><p>references in that paragraph to the Scottish Ministers are to be treated as references to the Regulator;</p></content></level><level class="para2" eId="schedule-2-paragraph-20-2-a-ii"><num>(ii)</num><content><p>the reference in paragraph 9(3) to being deemed to be registered as a social landlord is to be treated as a reference to being included in the register kept under section 20 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> (without prejudice to the Regulator’s power to remove the body under section 27 or 28 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>); and</p></content></level></level><level class="para1" eId="schedule-2-paragraph-20-2-b"><num>(b)</num><content><p>anything done by or in relation to the Scottish Ministers before the appointed day in relation to the matter (including any consent given by them) is to be regarded as having been done by or in relation to the Regulator.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-20-3"><num>(3)</num><intro><p>Sub-paragraph (2) ceases to have effect on 1st October 2012 if—</p></intro><level class="para1" eId="schedule-2-paragraph-20-3-a"><num>(a)</num><content><p>the Scottish Ministers had not given consent in relation to the matter before the appointed day; and</p></content></level><level class="para1" eId="schedule-2-paragraph-20-3-b"><num>(b)</num><content><p>the Regulator is, on 1st October 2012, not satisfied that the registered social landlord has consulted its tenants for the purposes of paragraph 9(6) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr>.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1426"><heading/><paragraph eId="schedule-2-paragraph-21" class="schProv1"><num>21.</num><subparagraph eId="schedule-2-paragraph-21-1"><num>(1)</num><intro><p>Sub-paragraph (2) applies where a registered social landlord which is a registered company has, before the appointed day—</p></intro><level class="para1" eId="schedule-2-paragraph-21-1-a"><num>(a)</num><content><p>applied to the Scottish Ministers for consent for the purposes of paragraph 10 of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr>; or</p></content></level><level class="para1" eId="schedule-2-paragraph-21-1-b"><num>(b)</num><content><p>taken steps to consult tenants for the purposes of sub-paragraph (7) of that paragraph.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-21-2"><num>(2)</num><intro><p>Where this sub-paragraph applies, on and after the appointed day—</p></intro><level class="para1" eId="schedule-2-paragraph-21-2-a"><num>(a)</num><intro><p>sections 100 to 104 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> do not apply in relation to the matter to which the application or consultation relates but paragraph 10 of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> is to continue to apply in relation to that matter with the following modifications—</p></intro><level class="para2" eId="schedule-2-paragraph-21-2-a-i"><num>(i)</num><content><p>references in that paragraph to the Scottish Ministers are to be treated as references to the Regulator;</p></content></level><level class="para2" eId="schedule-2-paragraph-21-2-a-ii"><num>(ii)</num><content><p>the reference in paragraph 10(9) to being deemed to be registered as a social landlord is to be treated as a reference to being included in the register kept under section 20 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> (without prejudice to the Regulator’s power to removed the body under section 27 or 28 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>); and</p></content></level></level><level class="para1" eId="schedule-2-paragraph-21-2-b"><num>(b)</num><content><p>anything done by or in relation to the Scottish Ministers before the appointed day in relation to the matter (including any consent given by them) is to be regarded as having been done by or in relation to the Regulator.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-21-3"><num>(3)</num><intro><p>Sub-paragraph (2) ceases to have effect on 1st October 2012 if—</p></intro><level class="para1" eId="schedule-2-paragraph-21-3-a"><num>(a)</num><content><p>the Scottish Ministers had not given consent in relation to the matter before the appointed day; and</p></content></level><level class="para1" eId="schedule-2-paragraph-21-3-b"><num>(b)</num><content><p>the Regulator is, on 1st October 2012, not satisfied that the registered social landlord has consulted its tenants for the purposes of paragraph 10(7) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr>.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1517"><heading/><paragraph eId="schedule-2-paragraph-22" class="schProv1"><num>22.</num><intro><p>Where the Scottish Ministers have presented a petition under paragraph 11 of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day, on and after that day—</p></intro><level class="para1" eId="schedule-2-paragraph-22-a"><num>(a)</num><content><p>the petition is to be treated as having been presented by the Regulator rather than by the Scottish Ministers; and</p></content></level><level class="para1" eId="schedule-2-paragraph-22-b"><num>(b)</num><content><p>anything done by or in relation to the Scottish Ministers before the appointed day in relation to the petition is to be regarded as having been done by or in relation to the Regulator.</p></content></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1542"><heading/><paragraph eId="schedule-2-paragraph-23" class="schProv1"><num>23.</num><subparagraph eId="schedule-2-paragraph-23-1"><num>(1)</num><content><p>This paragraph applies to any direction given by the Scottish Ministers under paragraph 12(2) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-23-2"><num>(2)</num><intro><p>On and after the appointed day—</p></intro><level class="para1" eId="schedule-2-paragraph-23-2-a"><num>(a)</num><content><p>a direction to which this paragraph applies is to be treated as having been given by the Regulator under section 106(2) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>; and</p></content></level><level class="para1" eId="schedule-2-paragraph-23-2-b"><num>(b)</num><content><p>anything done by or in relation to the Scottish Ministers before the appointed day in relation to the direction is to be regarded as having been done by or in relation to the Regulator.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-23-3"><num>(3)</num><content><p>Where, before the appointed day, the Scottish Ministers have consulted tenants under paragraph 12(5) of schedule 7 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> but have not yet given a direction in relation to that transfer under paragraph 12(2) of that schedule, the consultation is, on and after that day, to be regarded as having been undertaken by the Regulator under section 106(3) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> in relation to its power to make a direction under section 106(2) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1594"><heading>Consent: disposal of land</heading><paragraph eId="schedule-2-paragraph-24" class="schProv1"><num>24.</num><content><p>Any consent which is given by the Scottish Ministers under section 66(1) of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> before the appointed day is, on and after that day, to be treated as having been given by the Regulator under Part 9 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1610"><heading/><paragraph eId="schedule-2-paragraph-25" class="schProv1"><num>25.</num><subparagraph eId="schedule-2-paragraph-25-1"><num>(1)</num><intro><p>This paragraph applies where—</p></intro><level class="para1" eId="schedule-2-paragraph-25-1-a"><num>(a)</num><content><p>an application for consent under section 66(1) of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> is made, but not determined, before the appointed day; and</p></content></level><level class="para1" eId="schedule-2-paragraph-25-1-b"><num>(b)</num><content><p>the proposed disposal is not one to which schedule 9 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> applied.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-25-2"><num>(2)</num><intro><p>On and after the appointed day—</p></intro><level class="para1" eId="schedule-2-paragraph-25-2-a"><num>(a)</num><content><p>the application is to be treated as an application for consent under Part 9 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>; and</p></content></level><level class="para1" eId="schedule-2-paragraph-25-2-b"><num>(b)</num><content><p>anything done before the appointed day in pursuance of section 68(2) of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> is to be treated as having been done in pursuance of section 110(2) of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> (except that anything so done by or in relation to the Scottish Ministers is to be regarded as having been done by or in relation to the Regulator).</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1668"><heading/><paragraph eId="schedule-2-paragraph-26" class="schProv1"><num>26.</num><subparagraph eId="schedule-2-paragraph-26-1"><num>(1)</num><intro><p>Sub-paragraph (2) applies in relation to a disposal by a registered social landlord if, before the appointed day—</p></intro><level class="para1" eId="schedule-2-paragraph-26-1-a"><num>(a)</num><content><p>schedule 9 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> applied to the disposal; and</p></content></level><level class="para1" eId="schedule-2-paragraph-26-1-b"><num>(b)</num><intro><p>the registered social landlord has—</p></intro><level class="para2" eId="schedule-2-paragraph-26-1-b-i"><num>(i)</num><content><p>served a notice under paragraph 3(2) of schedule 9 to the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> in relation to the disposal; or</p></content></level><level class="para2" eId="schedule-2-paragraph-26-1-b-ii"><num>(ii)</num><content><p>given the Scottish Ministers notice that it proposes to make the disposal (by applying for consent under section 66(1) of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> or otherwise).</p></content></level></level></subparagraph><subparagraph eId="schedule-2-paragraph-26-2"><num>(2)</num><intro><p>Where this sub-paragraph applies, on and after the appointed day—</p></intro><level class="para1" eId="schedule-2-paragraph-26-2-a"><num>(a)</num><intro><p>section 110 and Part 10 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr> do not apply to the disposal but section 76 and schedule 9 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> are to continue to apply to the disposal with the following modifications—</p></intro><level class="para2" eId="schedule-2-paragraph-26-2-a-i"><num>(i)</num><content><p>references in those provisions to the Scottish Ministers are to be treated as references to the Regulator; and</p></content></level><level class="para2" eId="schedule-2-paragraph-26-2-a-ii"><num>(ii)</num><content><p>references in those provisions to consent under section 66 of the <abbr title="Housing (Scotland) Act 2001 asp 10">2001 Act</abbr> are to be treated as references to consent under Part 9 of the <abbr title="Housing (Scotland) Act 2010 asp 17">2010 Act</abbr>; and</p></content></level></level><level class="para1" eId="schedule-2-paragraph-26-2-b"><num>(b)</num><content><p>anything done by or in relation to the Scottish Ministers before the appointed day in relation to the disposal is to be regarded as having been so done by or in relation to the Regulator.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-26-3"><num>(3)</num><content><p>Sub-paragraph (2) ceases to have effect in relation to a disposal to which it would otherwise apply if the registered social landlord which proposes to make the disposal does not provide the certification required under paragraph 2(1) of
