5.  In section 28 omit subsection (2)(a) (inquiries as to priority need)(1), and the word “and” following it.

Section 28(2) would be amended by section 4(1) of the Homelessness etc. (Scotland) Act 2003 but the amendment is not in force and is revoked by this Order.
