The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section<span ukl:Name="NonBreakingSpace"> </span>53 of the Scotland Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c.46)</ref>.</p></authorialNote>) at a fixed location;</p></content></hcontainer><hcontainer name="definition"><content><p>“flexible service” has the meanings given in regulation 2(2A) of the Public Service Vehicles (Registration of Local Services) (Scotland) Regulations 2001<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00005" href="http://www.legislation.gov.uk/id/ssi/2001/219">S.S.I. 2001/219</ref>. The relevant amendments are by <ref eId="c00006" href="http://www.legislation.gov.uk/id/ssi/2012/32">S.S.I. 2012/32</ref>.</p></authorialNote>;</p></content></hcontainer></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-2-2-b"><num>(b)</num><content><p><mod>after the definition of “public passenger transport services” insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><hcontainer name="definition"><content><p>“registered particulars” means the particulars prescribed for the purposes of section<span ukl:Name="NonBreakingSpace"> </span>6(2)(a) of the Transport Act 1985;</p></content></hcontainer></quotedStructure><inline name="appendText">; and</inline></mod></p></content></level><level class="para1" eId="regulation-2-2-c"><num>(c)</num><content><p>omit the definition of “stopping place”.</p></content></level></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><intro><p>In regulation<span ukl:Name="NonBreakingSpace"> </span>3 (eligibility for grant)—</p></intro><level class="para1" eId="regulation-2-3-a"><num>(a)</num><content><p>in paragraph<span ukl:Name="NonBreakingSpace"> </span>(1)(b), omit the words from “which is provided” to “a timetable) and”;</p></content></level><level class="para1" eId="regulation-2-3-b"><num>(b)</num><content><p><mod>for paragraph<span ukl:Name="NonBreakingSpace"> </span>(2)(b) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><level class="para1"><num>(b)</num><intro><p>the stopping arrangements are such that—</p></intro><level class="para2"><num>(i)</num><content><p>all the fixed stopping places (whether marked or otherwise generally recognised) other than at the service termini are located where they are likely to be used with reasonable frequency by members of the public; and</p></content></level><level class="para2"><num>(ii)</num><content><p>in any section of the area of operation of the service where there are no fixed stopping places, the arrangements for determining when and where passengers may be taken up and set down are such that members of the public may take advantage of them with reasonable frequency;</p></content></level></level></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-2-3-c"><num>(c)</num><content><p><mod>for paragraph (2)(c) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><level class="para1"><num>(c)</num><content><p>members of the public are able to make a single journey between two stopping places (to the extent that such journeys are provided for in the registered particulars having regard to boarding and alighting restrictions) upon payment of a fare that is not a deliberate deterrent to their use of the service;</p></content></level><level class="para1"><num>(ca)</num><content><p>in the case of a flexible service, the advance booking arrangements are such that they do not act as a deterrent to members of the public wishing to make a single journey which is otherwise provided for in the registered particulars;</p></content></level></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-2-3-d"><num>(d)</num><content><p>in paragraph (2)(d) for “such members” substitute “members of the public”;</p></content></level><level class="para1" eId="regulation-2-3-e"><num>(e)</num><content><p><mod>for paragraph (3)(b) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><level class="para1"><num>(b)</num><intro><p>the stopping arrangements are such that—</p></intro><level class="para2"><num>(i)</num><content><p>all the fixed stopping places (whether marked or otherwise generally recognised) are located where they are likely to be used with reasonable frequency by members of the public;
