Coming into force

The Scottish Ministers make the following Order in exercise of the powers conferred by paragraph 7 of Schedule 1 to the Town and Country Planning (Scotland) Act 19971 and all other powers enabling them to do so.

In accordance with paragraph 9 of Schedule 1 to that Act they have consulted South Lanarkshire Council.

Citation and commencement1

This Order may be cited as the Town and Country Planning (Continuation in force of South Lanarkshire Local Plan) (Scotland) Order 2012 and comes into force on 29th June 2012.

Continuation in force of local plan2

The Scottish Ministers direct that, notwithstanding the adoption of the South Lanarkshire Minerals Local Development Plan2, the whole provisions of the South Lanarkshire Local Plan3 shall continue in force to full effect in relation to the area to which the South Lanarkshire Minerals Local Development Plan relates.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order continues in force the provisions of the South Lanarkshire Local Plan to full effect in relation to the area to which the South Lanarkshire Minerals Local Development Plan relates. In terms of paragraph 6 of Schedule 1 to the Town and Country Planning (Scotland) Act 1997 the provisions of that local plan would, but for this Order, cease to have effect on the adoption of the South Lanarkshire Minerals Local Development Plan so far as that local plan relates to the area to which the South Lanarkshire Minerals Local Development Plan relates.
