(This note is not part of the Order)
Section 40 of the Fire (Scotland) Act 2005 (“the Act”) requires the Scottish Ministers to prepare a document, which must set out priorities and objectives for relevant authorities in connection with the carrying out of their functions and containing related guidance and such other matters relating to those authorities or those functions as the Scottish Ministers consider appropriate. Under section 41(1) of the Act, relevant authorities must have regard to the document in carrying out their functions. Section 40(4) of the Act provides that the document has effect only when brought into effect by the Scottish Ministers by order. For this purpose, article 2 of this Order gives effect to the document prepared by the Scottish Ministers entitled Transitional Fire and Rescue Framework for Scotland 2012 which was published in June 2012. The document is available on the Scottish Government website: www.scotland.gov.uk/transitionalfireandrescueframework.
