Under section41(1) of the Act, relevant authorities must have regard to the document in carrying out their functions. Section40(4) of the Act provides that the document has effect only when brought into effect by the Scottish Ministers by order. For this purpose, article2 of this Order gives effect to the document prepared by the Scottish Ministers entitled Transitional Fire and Rescue Framework for Scotland 2012 which was published in June 2012. The Scottish Ministers make the following Order in exercise of the powers conferred by section40(4) of the Fire (Scotland) Act 2005 and all other powers enabling them to do so.
In accordance with section 40(5) of that Act, the Scottish Ministers, in preparing the document mentioned in section40(1) of that Act, consulted each relevant authority or such persons as they consider represent those authorities and such persons as they consider represent employees of those authorities.2005 asp 5.
