eId="section-1-2"><num>(2)</num><content><p>A certified copy of this Act of Sederunt is to be inserted in the Books of Sederunt.</p></content></paragraph><paragraph eId="section-1-3"><num>(3)</num><intro><p>In this Act of Sederunt—</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Bankruptcy and Diligence etc. (Scotland) Act 2007 asp 3">2007 Act</abbr>” means the Bankruptcy and Diligence <abbr title="et cetera" xml:lang="la">etc.</abbr> (Scotland) Act 2007;</p></content></hcontainer><hcontainer name="definition"><content><p>“decree for removing from heritable property” has the meaning given in section<span ukl:Name="NonBreakingSpace"> </span>214(1) of the <abbr title="Bankruptcy and Diligence etc. (Scotland) Act 2007 asp 3">2007 Act</abbr>;</p></content></hcontainer><hcontainer name="definition"><content><p>“charge for removing” means the charge for removing in the form prescribed by the Scottish Ministers under section<span ukl:Name="NonBreakingSpace"> </span>216(6) of the <abbr title="Bankruptcy and Diligence etc. (Scotland) Act 2007 asp 3">2007 Act</abbr><authorialNote class="footnote" eId="f00003" marker="3"><p>The Form of Charge for removing was prescribed by the Scottish Ministers in <ref eId="c00015" href="http://www.legislation.gov.uk/id/ssi/2011/158">S.S.I. 2011/158</ref>.</p></authorialNote>.</p></content></hcontainer></paragraph></article><article eId="section-2"><heading>Application</heading><num>2.</num><content><p>This Act of Sederunt prescribes the procedure and practice to be followed in the execution of any decree for removing from heritable property.</p></content></article><article eId="section-3"><heading>Charge for removing</heading><num>3.</num><paragraph eId="section-3-1"><num>(1)</num><intro><p>For the purposes of section<span ukl:Name="NonBreakingSpace"> </span>216(1)(a) of the <abbr title="Bankruptcy and Diligence etc. (Scotland) Act 2007 asp 3">2007 Act</abbr>, the charge for removing shall be served by a sheriff officer on the defender—</p></intro><level class="para1" eId="section-3-1-a"><num>(a)</num><content><p>personally; or</p></content></level><level class="para1" eId="section-3-1-b"><num>(b)</num><content><p>by being left in the hands of a resident at the defender’s dwelling place or an employee at his or her place of business; <noteRef href="#key-4340588c729ac034191656321ddbe97f" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>...</p></content></level></paragraph><paragraph eId="section-3-2"><num>(2)</num><intro><p>Where a sheriff officer has been unsuccessful in executing service in accordance with paragraph<span ukl:Name="NonBreakingSpace"> </span>(1), he or she may, after making diligent enquiries, serve the charge for removing—</p></intro><level class="para1" eId="section-3-2-a"><num>(a)</num><content><p>by depositing it in the defender’s dwelling place or place of business; or</p></content></level><level class="para1" eId="section-3-2-b"><num>(b)</num><content><p>by leaving it at that defender’s dwelling place or place of business in such a way that it is likely to come to the attention of the defender.</p></content></level></paragraph><paragraph eId="section-3-3"><num>(3)</num><content><p>Where service is executed under paragraph (2), the sheriff officer shall, as soon as possible after such service, send a letter containing a copy of the charge for removing by first class post to the address at which he or she thinks it most likely that the defender may be found.</p></content></paragraph><paragraph eId="section-3-4"><num>(4)</num><content><p>Where the defender is furth of Scotland, service will be executed in accordance with rule<span ukl:Name="NonBreakingSpace"> </span>5.5 (service on persons furth of Scotland) of the Ordinary Cause Rules 1993<authorialNote class="footnote" eId="f00004" marker="4"><p>The Ordinary Cause Rules are contained in Schedule<span ukl:Name="NonBreakingSpace"> </span>1 to the Sheriff Courts (Scotland) Act 1907, last amended by <ref eId="c00016" href="http://www.legislation.gov.uk/id/ssi/2011/386">S.S.I. 2011/386</ref>.</p></authorialNote>.</p></content></paragraph><paragraph eId="section-3-5"><num>(5)</num><intro><p>Where the address of the defender is not known and cannot reasonably be ascertained by the sheriff officer, the charge for removing shall be deemed to have been served on the defender if it is—</p></intro><level class="para1" eId="section-3-5-a"><num>(a)</num><content><p>left with or deposited at the office of the sheriff clerk of the sheriff court district where the  <ins class="substitution first last" ukl:ChangeId="key-74e8fccb16cf789b8543f3df31686f71-1784283715817" ukl:CommentaryRef="key-74e8fccb16cf789b8543f3df31686f71"><noteRef uk:name="commentary" href="#key-74e8fccb16cf789b8543f3df31686f71" class="commentary"/>heritable property</ins>  is located; and</p></content></level><level class="para1" eId="section-3-5-b"><num>(b)</num><content><p>displayed by the sheriff clerk on the walls of court for the period of the charge.</p></content></level></paragraph><paragraph eId="section-3-6"><num>(6)</num><content><p>Where service is executed under paragraph<span ukl:Name="NonBreakingSpace"> </span>(5) the period of charge shall run from the first date on which it was displayed on the walls of the court.</p></content></paragraph><paragraph eId="section-3-7"><num>(7)</num><intro><p>Where service is executed in accordance with this rule, the sheriff officer shall leave a copy of the charge for removing at the heritable property—</p></intro><level class="para1" eId="section-3-7-a"><num><ins class="substitution first" ukl:ChangeId="key-68dce9eb697276833d9063b86dd4920a-1784284023627" ukl:CommentaryRef="key-68dce9eb697276833d9063b86dd4920a"><noteRef uk:name="commentary" href="#key-68dce9eb697276833d9063b86dd4920a" class="commentary"/>(a)</ins></num><content><p><ins class="substitution last" ukl:ChangeId="key-68dce9eb697276833d9063b86dd4920a-1784284023627" ukl:CommentaryRef="key-68dce9eb697276833d9063b86dd4920a">by leaving a copy of the charge in a sealed envelope addressed to “the occupiers” in such a way that it is likely to come to the attention of the occupiers; or</ins></p></content></level><level class="para1" eId="section-3-7-b"><num>(b)</num><content><p>in the case of land only, inserting stakes in the ground at conspicuous parts of the occupied land to each of which is attached a sealed envelope containing a copy of the charge addressed to “the occupiers”.</p></content></level></paragraph><paragraph eId="section-3-8"><num>(8)</num><intro><p>On the face of the envelope used under paragraph (7) there shall be written or printed the following notice:—</p></intro><hcontainer name="definition"><content><p>TAKE NOTICE: this envelope contains a copy of a charge for removing from a Sheriff Officer.</p></content></hcontainer></paragraph></article><article eId="section-4"><heading>Notice of date of removal</heading><num>4.</num><paragraph eId="section-4-1"><num>(1)</num><intro><p>Prior to the execution of a decree for removing from heritable property, notice of the date of removal shall be served by the sheriff officer, in Form<span ukl:Name="NonBreakingSpace"> </span>4, by—</p></intro><level class="para1" eId="section-4-1-a"><num>(a)</num><content><p>leaving the notice at the heritable property; and</p></content></level><level class="para1" eId="section-4-1-b"><num>(b)</num><content><p>sending a copy of the notice by first class post to the address at which he thinks it most likely that the defender may be found.</p></content></level></paragraph><paragraph eId="section-4-2"><num>(2)</num><content><p>The date specified in the notice of the date of removal shall be a period of notice of not less than 48 hours after the notice is served.</p></content></paragraph><paragraph eId="section-4-3"><num>(3)</num><content><p>The sheriff may, on the application of the pursuer, on cause shown, vary or dispense with the period of notice mentioned in subparagraph<span ukl:Name="NonBreakingSpace"> </span>(2).</p></content></paragraph></article><article eId="section-5"><heading>Evidence of service and notice</heading><num>5.</num><intro><p>It shall be sufficient evidence that—</p></intro><level class="para1" eId="section-5-a"><num>(a)</num><content><p>a charge for removing mentioned in paragraph<span ukl:Name="NonBreakingSpace"> </span>3 has been served;</p></content></level><level class="para1" eId="section-5-b"><num>(b)</num><content><p>a notice of the date of removal mentioned in paragraph<span ukl:Name="NonBreakingSpace"> </span>4 has been served,</p></content></level><wrapUp><p>if a certificate to that effect is signed by the sheriff officer.</p></wrapUp></article><article eId="section-6"><heading>Inventory of effects removed</heading><num>6.</num><paragraph eId="section-6-1"><num>(1)</num><content><p>For the purposes of section<span ukl:Name="NonBreakingSpace"> </span>216(3)(b) of the <abbr title="Bankruptcy and Diligence etc. (Scotland) Act 2007 asp 3">2007 Act</abbr> the inventory of effects removed shall be in Form<span ukl:Name="NonBreakingSpace"> </span>6.</p></content></paragraph><paragraph eId="section-6-2"><num>(2)</num><content><p>The inventory shall be witnessed.</p></content></paragraph></article><article eId="section-7"><heading>Execution of decree</heading><num>7.</num><paragraph eId="section-7-1"><num>(1)</num><content><p>This rule applies where a decree for removing from heritable property has been executed.</p></content></paragraph><paragraph eId="section-7-2"><num>(2)</num><content><p>The sheriff officer shall complete a certificate of execution in Form<span ukl:Name="NonBreakingSpace"> </span>7.</p></content></paragraph><paragraph eId="section-7-3"><num>(3)</num><content><p>The certificate of execution shall be witnessed.</p></content></paragraph><paragraph eId="section-7-4"><num>(4)</num><intro><p>A copy of the certificate of execution shall be—</p></intro><level class="para1" eId="section-7-4-a"><num>(a)</num><content><p>affixed to the main door or other conspicuous part of the heritable property in a sealed envelope; or</p></content></level><level class="para1" eId="section-7-4-b"><num>(b)</num><content><p>in the case of land only, attached, in a sealed envelope, to stakes in the ground at conspicuous parts of the
