SCHEDULE 3REVOCATIONS 2012 No. 130 Made 25th April 2012 Laid before the Scottish Parliament 27th April 2012 Coming into force 8th December 2012 The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 2 and28B(1)(a)(ii) and (3) of the Education (Scotland) Act 1980 and all other powers enabling them to do so. 1980 c.44 (“the 1980 Act”). Section 2 was amended by Schedule 6 to the Education (Scotland) Act 1996 (c.43). Section28B was inserted by section 1(1) of the Education (Scotland) Act 1981 (c.58) (“the 1981 Act”) and amended by schedule3, paragraph 3(6) to the Education (Additional Support for Learning) (Scotland) Act 2004 (asp 4) (“the 2004 Act”). Section135(1) of the 1980 Act sets out the definition of “prescribed” relevant to the exercise of the statutory powers under which these Regulations are made. The functions of the Secretary of State under the 1980 Act were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).
