The Order also extinguishes rights of navigation in the harbour to the extent that they would be affected by those works, or by works carried out by the Council in 2005 that were not previously the subject of a Harbour Revision Order.</dc:description>

               <P>
                  <Text>The Scottish Ministers (the “Ministers”) make the following Order in exercise of the powers conferred by section<Character Name="NonBreakingSpace"/>14(1) and (3) of the Harbours Act 1964<FootnoteRef Ref="f00001"/> and all other powers enabling Ministers to do so.</Text>
               </P>
               <P>
                  <Text>In accordance with section<Character Name="NonBreakingSpace"/>14(1) of that Act, this Order is made in relation to a harbour which is being improved, maintained or managed by a harbour authority in the exercise and performance of statutory powers and duties, for achieving objects specified in Schedule<Character Name="NonBreakingSpace"/>2 to that Act<FootnoteRef Ref="f00002"/>.</Text>
               </P>
               <P>
                  <Text>In accordance with section<Character Name="NonBreakingSpace"/>14(2) of that Act—</Text>

                        <Text>this Order is made following a written application to Ministers by The Argyll and Bute Council (“the Council”) being the authority engaged in improving, maintaining or managing the harbour; and</Text>
                     </P3para>

                     <Pnumber>b</Pnumber>
                     <P3para>
                        <Text>Ministers are satisfied that the making of this Order is desirable in the interests of securing the improvement, maintenance, or management of the harbour in an efficient and economical manner and facilitating the efficient and economic transport of goods or passengers by sea.</Text>

                  <Text>In accordance with paragraph<Character Name="NonBreakingSpace"/>5 of that Schedule<FootnoteRef Ref="f00007"/>, Ministers have informed the Council in writing that the application relates to a project which falls within Annex<Character Name="NonBreakingSpace"/>
                     II to that Directive but is not a relevant project.</Text>
