For section 12E(4) and (5) of the Sheriff Courts (Scotland) Act 19718 substitute—

“(4)

Such an order—

(a)

is subject to the negative procedure; and

(b)

is not to be made so as to come into effect before the expiry, in relation to the instrument containing the order, of the period of 40 days mentioned in section 28(3) of the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10).”.
