The functions of the Lord Advocate were transferred to the Secretary of State by <ref eId="c00002" href="http://www.legislation.gov.uk/id/uksi/1999/678">S.I.<span ukl:Name="NonBreakingSpace"> </span>1999/678</ref>. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section<span ukl:Name="NonBreakingSpace"> </span>53 of the Scotland Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c.46)</ref>.</p></authorialNote> and of all other powers enabling them to do so.</p><formula name="enactingText"><p>In accordance with section<span ukl:Name="NonBreakingSpace"> </span>9 they have consulted the Administrative Justice and Tribunals Council and that Council has consulted its Scottish Committee.</p></formula></preamble><body><rule eId="article-1"><heading>Citation and commencement</heading><num>1.</num><content><p>These Rules may be cited as the Town and Country Planning (Inquiries Procedure) (Scotland) Amendment Rules 2011 and come into force on 1st<span ukl:Name="NonBreakingSpace"> </span>December 2011.</p></content></rule><rule eId="article-2"><heading>Amendment of the Town and Country Planning (Inquiries Procedure) (Scotland) Rules<span ukl:Name="NonBreakingSpace"> </span>1997</heading><num>2.</num><paragraph eId="article-2-1"><num>(1)</num><content><p>The Town and Country Planning (Inquiries Procedure) (Scotland) Rules 1997<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00004" href="http://www.legislation.gov.uk/id/uksi/1997/796">S.I.<span ukl:Name="NonBreakingSpace"> </span>1997/796</ref> as amended by <ref eId="c00005" href="http://www.legislation.gov.uk/id/uksi/1998/2311">S.I.<span ukl:Name="NonBreakingSpace"> </span>1998/2311</ref>, <ref eId="c00006" href="http://www.legislation.gov.uk/id/ssi/2004/332">S.S.I.<span ukl:Name="NonBreakingSpace"> </span>2004/332</ref> and <ref eId="c00007" href="http://www.legislation.gov.uk/id/ssi/2009/212">2009/212</ref>.</p></authorialNote> are amended in accordance with paragraphs<span ukl:Name="NonBreakingSpace"> </span>(2) and (3).</p></content></paragraph><paragraph eId="article-2-2"><num>(2)</num><intro><p>In rule 2(2) (application of rules)—</p></intro><level class="para1" eId="article-2-2-a"><num>(a)</num><content><p>in paragraph<span ukl:Name="NonBreakingSpace"> </span>(a) after “Act” insert “or section 11 of the Listed Buildings Act”;
