CONFINEMENT AND CUSTODY OF PRISONERS

Temporary confinement in a special cell97.

(1)

The Governor may order the temporary confinement in a special cell of any prisoner who is behaving in a threatening, abusive or violent manner.

(2)

The following conditions apply to all orders made under paragraph (1) and the enforcement of such orders—

(a)

the Governor must keep a written record of the particulars of each order made under paragraph (1) including the reasons for making the order;

(b)

the Governor must inform a healthcare professional as soon as possible after making an order under paragraph (1) and consider any recommendations made by the healthcare professional;

(c)

an order under paragraph (1) must not be used as a punishment;

(d)

an officer must visit the prisoner at least once in every 15 minutes during the period that the prisoner is confined in a special cell; and

(e)

a prisoner must not be confined in a special cell for any longer than is necessary and, in any event, for no longer than a continuous period of 24 hours.
