Ministers are the “appropriate licensing authority”.</p></authorialNote> and sections<span ukl:Name="NonBreakingSpace"> </span>38, 61 and 165(1) of the Marine (Scotland) Act 2010<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00002" href="http://www.legislation.gov.uk/id/asp/2010/5">2010 asp<span ukl:Name="NonBreakingSpace"> </span>5</ref>.</p></authorialNote> and all other powers enabling them to do so.</p><formula name="enactingText"><p>In accordance with section 316(6) of the Marine and Coastal Access Act 2009 and section 165(5) of the Marine (Scotland) Act 2010, a draft of these Regulations has been laid before, and approved by a resolution of, the Scottish Parliament.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation and commencement</heading><num>1.</num><content><p>These Regulations may be cited as the Marine Licensing Appeals (Scotland) Regulations 2011 and come into force on 6th April 2011.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><intro><p>In these Regulations—</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Marine and Coastal Access Act 2009 c. 23">2009 Act</abbr>” means the Marine and Coastal Access Act 2009;</p></content></hcontainer><hcontainer name="definition"><content><p>“the <abbr title="Marine (Scotland) Act 2010 asp 5">2010 Act</abbr>” means the Marine (Scotland) Act 2010.</p></content></hcontainer></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Appeals against marine licensing decisions</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><content><p>A person who has applied for a marine licence may by summary application appeal to the sheriff of any sheriffdom against a decision taken by the Scottish Ministers under section<span ukl:Name="NonBreakingSpace"> </span>71(1) of the <abbr title="Marine and Coastal Access Act 2009 c. 23">2009 Act</abbr> or section<span ukl:Name="NonBreakingSpace"> </span>29(1) of the <abbr title="Marine (Scotland) Act 2010 asp 5">2010 Act</abbr>.</p></content></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><intro><p>On determining an appeal under paragraph<span ukl:Name="NonBreakingSpace"> </span>(1), the sheriff may—</p></intro><level class="para1" eId="regulation-3-2-a"><num>(a)</num><content><p>dismiss the appeal; or</p></content></level><level class="para1" eId="regulation-3-2-b"><num>(b)</num><content><p>allow the appeal and quash the decision in whole or in part.</p></content></level></paragraph><paragraph eId="regulation-3-3"><num>(3)</num><intro><p>Where a decision is quashed, the sheriff may direct the Scottish Ministers—</p></intro><level class="para1" eId="regulation-3-3-a"><num>(a)</num><content><p>to grant a marine licence; or</p></content></level><level class="para1" eId="regulation-3-3-b"><num>(b)</num><content><p>to grant a marine licence on such terms or subject to such conditions as the sheriff may direct.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Appeals against notices</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><content><p>A person to whom any of the notices referred to in paragraph<span ukl:Name="NonBreakingSpace"> </span>(2) has been issued by the Scottish Ministers may by summary application appeal to the sheriff of any sheriffdom against the notice.</p></content></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><intro><p>The notices are—</p></intro><level class="para1" eId="regulation-4-2-a"><num>(a)</num><content><p>a notice under section<span ukl:Name="NonBreakingSpace"> </span>72 of the <abbr title="Marine and Coastal Access Act 2009 c. 23">2009 Act</abbr> or section<span ukl:Name="NonBreakingSpace"> </span>30 of the <abbr title="Marine (Scotland) Act 2010 asp 5">2010 Act</abbr>, being a notice varying, suspending or revoking a marine licence or extending a period of suspension;</p></content></level><level class="para1" eId="regulation-4-2-b"><num>(b)</num><content><p>a compliance notice under section<span ukl:Name="NonBreakingSpace"> </span>90 of the <abbr title="Marine and Coastal Access Act 2009 c. 23">2009 Act</abbr> or section<span ukl:Name="NonBreakingSpace"> </span>43 of the <abbr title="Marine (Scotland) Act 2010 asp 5">2010 Act</abbr>;</p></content></level><level class="para1" eId="regulation-4-2-c"><num>(c)</num><content><p>a remediation notice under section<span ukl:Name="NonBreakingSpace"> </span>91 of the <abbr title="Marine and Coastal Access Act 2009 c. 23">2009 Act</abbr> or section<span ukl:Name="NonBreakingSpace"> </span>44 of the <abbr title="Marine (Scotland) Act 2010 asp 5">2010 Act</abbr>;</p></content></level><level class="para1" eId="regulation-4-2-d"><num>(d)</num><content><p>a stop notice under section<span ukl:Name="NonBreakingSpace"> </span>102 of the <abbr title="Marine and Coastal Access Act 2009 c. 23">2009 Act</abbr> or section<span ukl:Name="NonBreakingSpace"> </span>55 of the <abbr title="Marine (Scotland) Act 2010 asp 5">2010 Act</abbr>;</p></content></level><level class="para1" eId="regulation-4-2-e"><num>(e)</num><content><p>an emergency safety notice under section<span ukl:Name="NonBreakingSpace"> </span>104 of the <abbr title="Marine and Coastal Access Act 2009 c. 23">2009 Act</abbr> or section<span ukl:Name="NonBreakingSpace"> </span>57 of the <abbr title="Marine (Scotland) Act 2010 asp 5">2010 Act</abbr>.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Suspension of notices</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>A notice referred to in regulation<span ukl:Name="NonBreakingSpace"> </span>4(2)(a) varying a marine licence is suspended in relation to that variation pending determination of the appeal.</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><content><p>The sheriff may suspend any other notice referred to in regulation<span ukl:Name="NonBreakingSpace"> </span>4(2)(a), wholly or in part, pending determination of the appeal.</p></content></paragraph><paragraph eId="regulation-5-3"><num>(3)</num><content><p>A notice referred to in regulation<span ukl:Name="NonBreakingSpace"> </span>4(2)(b) or (c), and any requirement in any such notice, is suspended pending determination of an appeal against the notice.</p></content></paragraph><paragraph eId="regulation-5-4"><num>(4)</num><content><p>The sheriff may suspend a notice referred to in regulation<span ukl:Name="NonBreakingSpace"> </span>4(2)(d) or (e).</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Powers of sheriff</heading><num>6.</num><intro><p>On determining an appeal under regulation<span ukl:Name="NonBreakingSpace"> </span>4(1), the sheriff may—</p></intro><level class="para1" eId="regulation-6-a"><num>(a)</num><content><p>withdraw the notice or any requirement contained in it;</p></content></level><level class="para1" eId="regulation-6-b"><num>(b)</num><content><p>confirm the notice or any requirement contained in it;</p></content></level><level class="para1" eId="regulation-6-c"><num>(c)</num><content><p>vary the notice or any requirement contained in it;</p></content></level><level class="para1" eId="regulation-6-d"><num>(d)</num><content><p>remit the A refusal can be appealed, as can a decision to grant a licence with conditions.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulations 4 deals with appeals against the following types of notice—</p><blockContainer ukl:Name="P3" class="para1"><num>(a)</num><p>a notice varying, suspending or revoking a marine licence or extending a period of suspension;</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(b)</num><p>a compliance notice;</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(c)</num><p>a remediation notice;</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(d)</num><p>a stop notice; and</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(e)</num><p>an emergency safety notice.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><p>Regulation 5 concerns the suspension of notices when an appeal is lodged and regulation 6 deals with the powers of the sheriff when determining an appeal under regulation 4.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
