Coming into force in accordance with regulation 1
The Scottish Ministers make the following Regulations in exercise of the powers conferred by paragraph 7 of schedule 2 to the Regulation of Care (Scotland) Act 2001(1) and all other powers enabling them to do so.
In accordance with paragraph 7 of schedule 2 to that Act they have consulted with such persons or groups of persons as they consider appropriate.
1. These Regulations may be cited as the Scottish Social Services Council (Appointments, Procedure and Access to the Register) Amendment (No. 2) Regulations 2010 and come into force on the same day as section 44 (the scheme) of the Protection of Vulnerable Groups (Scotland) Act 2007(2).
2. In regulation 4(1) (disqualification for appointment) of the Scottish Social Services Council (Appointments, Procedure and Access to the Register) Regulations 2001(3)—
(a)omit “and” from the end of sub-paragraph (f);
(b)after “suspended” in sub-paragraph (g) insert—
“; and
(h)any person barred from regulated work with children or adults within the meaning of section 92(1) or (2) of the Protection of Vulnerable Groups (Scotland) Act 2007”.

These Regulations come into force on the same day as section 44 (which establishes the new vetting and disclosure scheme) of the Protection of Vulnerable Groups (Scotland) Act 2007 (“the 2007 Act”); that day will be appointed by the Scottish Ministers by an order under that Act.
Regulation 2 amends regulation 4(1) of the Scottish Social Services Council (Appointments, Procedure and Access to the Register) Regulations 2001 to provide that any person barred from regulated work with children or adults within the meaning of section 92(1) and (2) of the 2007 Act is disqualified from appointment as convener or member of the Scottish Social Services Council.
