This Order may be cited as the Education (Additional Support for Learning) (Scotland) Act 2009 (Commencement No. 2) Order 2010.
Appointed day2.
(1)
Subject to paragraphs (2) and (3), the provisions of the Education (Additional Support for Learning) (Scotland) Act 2009, so far as not already in force, come into force on 14th November 2010.

Paragraph (1) does not apply to section 23.
(3)
Section 18(2) comes into force on that date immediately after section 19(2) comes into force.

This Order brings into force on 14th November 2010 the provisions of the Education (Additional Support for Learning) (Scotland) Act 2009 (“the Act”) which are yet to be commenced, except for section 23 (collection of data on additional support needs).
Sections 18(2) and 19(2) of the Act both amend section 19(3) of the Education (Additional Support for Learning) (Scotland) Act 2004 (asp 4). The amendment made by section 19(2) of the Act must legally apply before the amendment made by section 18(2), article 2(3) accordingly provides that the former comes into force immediately before the latter.
Sections 1(5), 12, 16 and 20 of the Act were brought into force on 2nd April 2010 by virtue of the Education (Additional Support for Learning) (Scotland) Act 2009 (Commencement No. 1) Order 2010 (S.S.I. 2010/129).
