Coming into force in accordance with regulation 1

The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 73(g) and 97(1)1 of the Protection of Vulnerable Groups (Scotland) Act 20072 and all other powers enabling them to do so.

Citation, commencement and interpretation1

These Regulations may be cited as the Protection of Vulnerable Groups (Scotland) Act 2007 (Health Professionals) (Health Service Lists) Regulations 2010 and come into force on the same day as section 44 of the Protection of Vulnerable Groups (Scotland) Act 2007.

Prescribed purpose2

The suitability for inclusion in any list prepared by virtue of section 17P or for the purposes of Part II of the National Health Service (Scotland) Act 19783, of an individual who is—

a

a dental practitioner undertaking to provide or assisting with the provision of general dental services;

b

a medical practitioner or an ophthalmic optician undertaking to provide or assisting with the provision of general ophthalmic services;

c

a person undertaking to provide pharmaceutical services; or

d

a person performing a primary medical service,

is prescribed for the purposes of section 73(g) of the Protection of Vulnerable Groups (Scotland) Act 2007.

EXPLANATORY NOTE

(This note is not part of the Regulations)

Regulation 2 of these Regulations prescribes the suitability for inclusion in any list prepared by virtue of section 17P or for the purposes of Part II of the National Health Service (Scotland) Act 1978 of an individual who is a dental practitioner undertaking to provide or assisting with the provision of general dental services, a medical practitioner or an ophthalmic optician undertaking to provide or assisting with the provision of general ophthalmic services, a person undertaking to provide pharmaceutical services, or a person performing a primary medical service, as a purpose in terms of section 73(g) of the Protection of Vulnerable Groups (Scotland) Act 2007.
