<Text>In this Order—</Text>

<Para><Text>“administrative site” means premises in which documents or records relating to a production site are kept;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“Commission Regulation” means <Citation URI="http://www.legislation.gov.uk/european/regulation/2009/0616" id="c00002" Year="2009" Number="0616" Class="EuropeanUnionRegulation">Commission Regulation (EC) No. 616/2009</Citation> implementing Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2005/0094" id="c00003" Class="EuropeanUnionDirective" Year="2005" Number="94">2005/94/<Acronym Expansion="European Community">EC</Acronym></Citation> as regards the approval of poultry compartments and other captive birds compartments with respect to avian influenza and additional preventive biosecurity measures in such compartments<FootnoteRef Ref="f00003"/> as amended from time to time; and</Text>

<Para><Text>“production site” means premises where poultry are kept for the purposes of breeding, rearing, fattening or egg production and which are the subject of an application under article 4.</Text>

<P1group RestrictExtent="S" RestrictStartDate="2020-12-31"><Title>Powers of inspectors</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2010/150/article/5" IdURI="http://www.legislation.gov.uk/id/ssi/2010/150/article/5" id="article-5"><Pnumber><CommentaryRef Ref="key-c9706a8872ef0d718e743af25a9ca2bb"/>5</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2010/150/article/5/1" IdURI="http://www.legislation.gov.uk/id/ssi/2010/150/article/5/1" id="article-5-1"><Pnumber>1</Pnumber><P2para><Text>An inspector may, for any purpose relating to this Order or to the Commission Regulation—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2010/150/article/5/1/a" IdURI="http://www.legislation.gov.uk/id/ssi/2010/150/article/5/1/a" id="article-5-1-a"><Pnumber>a</Pnumber><P3para><Text>enter any administrative site, production site or compartment;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2010/150/article/5/1/b" IdURI="http://www.legislation.gov.uk/id/ssi/2010/150/article/5/1/b" id="article-5-1-b"><Pnumber>b</Pnumber><P3para><Text>have access to, and inspect, any document or record;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2010/150/article/5/1/c" IdURI="http://www.legislation.gov.uk/id/ssi/2010/150/article/5/1/c" id="article-5-1-c"><Pnumber>c</Pnumber><P3para><Text>remove and retain a copy of any document or record;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2010/150/article/5/1/d" IdURI="http://www.legislation.gov.uk/id/ssi/2010/150/article/5/1/d" id="article-5-1-d"><Pnumber>d</Pnumber><P3para><Text>have access to, and check the operation of, any computer and any associated apparatus or material which is or has been used in connection with a document or record;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2010/150/article/5/1/e" IdURI="http://www.legislation.gov.uk/id/ssi/2010/150/article/5/1/e" id="article-5-1-e"><Pnumber>e</Pnumber><P3para><Text>where a document or record is kept by means of a computer, require the document or record to be produced in a form in which it may be taken away; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2010/150/article/5/1/f" IdURI="http://www.legislation.gov.uk/id/ssi/2010/150/article/5/1/f" id="article-5-1-f"><Pnumber>f</Pnumber><P3para><Text>be accompanied by <CommentaryRef Ref="key-eb4c2ecff03a71d6a0ff4849a1fddeb3"/>... any person the inspector considers necessary.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2010/150/article/5/2" IdURI="http://www.legislation.gov.uk/id/ssi/2010/150/article/5/2" id="article-5-2"><Pnumber>2</Pnumber><P2para><Text>A person required to do anything by an inspector acting under paragraph (1) must, unless that person has reasonable cause, do so without delay.</Text></P2para></P2></P1para></P1></P1group>

<P><Text Hanging="indented">This Order implements <Citation URI="http://www.legislation.gov.uk/european/regulation/2009/0616" id="c00004" Year="2009" Number="0616" Class="EuropeanUnionRegulation">Commission Regulation (EC) No. 616/2009</Citation> (“the Commission Regulation”) which makes provision for the approval of poultry compartments which meet certain biosecurity standards.</Text></P>
<P><Text Hanging="indented">Article 3 provides that the Scottish Ministers are the competent authority for the purposes of the Commission Regulation.</Text></P>
<P><Text Hanging="indented">Article 4 provides that applications for approval of compartments must be made in such form as the Scottish Ministers may require. Application for approval is voluntary. The Commission Regulation requires the competent authority to suspend approval of a compartment in the event of non-compliance with the information submitted in the application for approval, or with the criteria and requirements set out in the Annex to the Commission Regulation. Following suspension, the competent authority is required to withdraw approval if there is continued non-compliance or in the event of an outbreak of avian influenza in the compartment.</Text></P>
<P><Text Hanging="indented">Article 5 sets out the powers under the Order of persons appointed as inspectors under the Animal Health Act 1981. Refusing entry to, or otherwise obstructing or impeding an inspector in the execution of the inspector’s duties under article 5 is an offence under section 66 of that Act.</Text></P>
<P><Text Hanging="indented">A regulatory impact assessment has not been prepared for this instrument.</Text></P>
