The Education (Additional Support for Learning) (Scotland) Act 2009 (Commencement No. 1) Order 2010

The Scottish Ministers make the following Order in exercise of the powers conferred by section 26(3) of the Education (Additional Support for Learning) (Scotland) Act 2009(1) and all other powers enabling them to do so.

Citation

1.  This Order may be cited as the Education (Additional Support for Learning) (Scotland) Act 2009 (Commencement No. 1) Order 2010.

Appointed day

2.  The following provisions of the Education (Additional Support for Learning) (Scotland) Act 2009 come into force on 2nd April 2010—

(a)section 1(5) (co-ordinated support plans: further provision);

(b)section 12 (dispute resolution);

(c)section 16 (power to specify additional sources of information);

(d)section 20 (power to make rules in respect of Tribunal practice and procedure).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force on 2nd April 2010, the following provisions of the Education (Additional Support for Learning) (Scotland) Act 2009—

(a)section 1(5) (which relates to the transfer of co-ordinated support plans);

(b)section 12 (which relates to applications for dispute resolution being made to the Scottish Ministers);

(c)section 16 (which relates to a power enabling the Scottish Ministers, by order to specify persons from whom advice, information and support may be obtained);

(d)section 20 (which relates to failure to comply with certain timescales being determined by the convener of an Additional Support Needs Tribunal, and enables decisions of a Tribunal to be reviewed).

The provisions commenced relate to powers of the Scottish Ministers to make orders or regulations.
