<Title>Interpretation</Title>

<P2para><Text>In these Regulations—</Text>
<UnorderedList Decoration="none" Class="Definition">
<ListItem>
<Para><Text>“the Act” means the Wildlife and Countryside Act 1981;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“<Term id="term-keep">keep</Term>” means keep, possess or control;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“<Term id="term-keeper">keeper</Term>” means the person who keeps, or has possession of, or control over, a bird;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“<Term id="term-register">register</Term>” means the register referred to in regulation<Character Name="NonBreakingSpace"/>3(1); and</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“<Term id="term-ring">ring</Term>” means any ring or band for ringing a bird.</Text>
</Para>
</ListItem>

<Text>Any reference to a bird to which these Regulations apply is a reference to any bird included in Schedule<Character Name="NonBreakingSpace"/>4 to the Act which any person keeps, possesses or controls.</Text>
</P2para>

<P1group>
<Title>Registration</Title>

<Pnumber>1</Pnumber>
<P2para><Text>The Scottish Ministers must, for the purposes of section<Character Name="NonBreakingSpace"/>7(1) of the Act, maintain a register of birds to which these Regulations apply which are kept at addresses in Scotland.</Text>
</P2para>
</P2>

<Pnumber>2</Pnumber>
<P2para>
<Text>An application for registration must be made by either the keeper or the prospective keeper of the bird to which the application relates.</Text>
</P2para>
</P2>

<Pnumber>3</Pnumber>

<Text>The Scottish Ministers must not register any bird on the register unless it has been ringed or marked in accordance with regulation<Character Name="NonBreakingSpace"/>6(1).</Text>
</P2para>
</P2>

<Text>The Scottish Ministers may decline to make an entry in the register if an application is not accompanied by any charge determined under section<Character Name="NonBreakingSpace"/>7(2A)<FootnoteRef Ref="f00002"/> of the Act.</Text>

<Title>Termination of registration</Title>

<P2para><Text>Registration ceases to have effect when—</Text>

<Text>the registered bird—</Text>

<Text>the ring or marking referred to in regulation<Character Name="NonBreakingSpace"/>6(1) is removed or the identifying information on it or stored within it becomes unreadable;</Text>
</P3para></P3>

<Pnumber>c</Pnumber>

<Text>the registered bird is kept by a person other than its registered keeper, unless it is intended at the time when the bird begins to be so kept that it will be returned to its registered keeper within the specified period and the bird is so returned, and in this sub-paragraph “<Term id="term-the-specified-period">the specified period</Term>” means—</Text>

<Pnumber>i</Pnumber>

<Text>where the bird will not be kept continuously at its registered address, a period of three<Character Name="NonBreakingSpace"/>weeks; and</Text>
</P4para></P4>

<Text>where the bird will be kept continuously at its registered address, a period of six<Character Name="NonBreakingSpace"/>weeks;</Text>
</P4para></P4>

<Pnumber>d</Pnumber>
<P3para>
<Text>the registered bird is kept by its registered keeper but ceases to be kept at its registered address, unless—</Text>

<Pnumber>i</Pnumber>

<Text>it is intended at the time when the bird ceases to be so kept that it will be returned to its registered address within three<Character Name="NonBreakingSpace"/>weeks and the bird is so returned; or</Text>
</P4para></P4>

<Text>the Scottish Ministers are notified in writing before the bird ceases to be so kept of the new address at which it will be kept (being an address in Scotland) and the date from which it will be so kept.</Text>
</P4para></P4>

</P2>

<Pnumber>2</Pnumber>
<P2para>
<Text>In this regulation—</Text>
<UnorderedList Decoration="none" Class="Definition">
<ListItem>
<Para><Text>“<Term id="term-registered-address">registered address</Term>” means the address at which the bird was kept at the date of registration by the Scottish Ministers, or, if an address has been notified to the Scottish Ministers under paragraph<Character Name="NonBreakingSpace"/>(1)(d)(ii), the address notified or last notified under that provision; and</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“<Term id="term-registered-keeper">registered keeper</Term>” in relation to a registered bird means the person who made the application in respect of which the bird is registered by the Scottish Ministers.</Text>
</Para>
</ListItem>

<Title>Birds registered on CITES register</Title>

<Pnumber>5</Pnumber>
<P1para>
<P2 DocumentURI="http://www.legislation.gov.uk/ssi/2009/419/regulation/5/1/made" IdURI="http://www.legislation.gov.uk/id/ssi/2009/419/regulation/5/1" id="regulation-5-1">
<Pnumber>1</Pnumber>
<P2para><Text>Where a bird of a species listed in the Schedule is registered on the CITES register, it is treated as being registered in accordance with these Regulations for the purposes of section<Character Name="NonBreakingSpace"/>7(1) of the Act and—</Text>

<Text>regulation 3; and</Text>

<Text>do not apply in respect of birds registered by virtue of this paragraph.</Text>

<Text>In this regulation—</Text>

<Para><Text>“CITES” means the Convention on International Trade in Endangered Species of Wild Fauna and Flora<FootnoteRef Ref="f00003"/>;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“CITES certificate” means a certificate referred to in Article<Character Name="NonBreakingSpace"/>10 of Council Regulation (EC) No.<Character Name="NonBreakingSpace"/>338/97 on the protection of species of wild fauna and flora by regulating trade therein<FootnoteRef Ref="f00004"/> issued by the management authority for the United Kingdom<FootnoteRef Ref="f00005"/>; and</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“CITES register” means any register of birds in respect of which a CITES certificate has been issued.</Text>
</Para>
</ListItem>

<Title>Ringing</Title>

<Pnumber>1</Pnumber>
<P2para><Text>Every bird to which these Regulations apply must be ringed with a ring obtained from the Scottish Ministers unless it has been marked in accordance with the specimen marking requirements of Article<Character Name="NonBreakingSpace"/>66 of Commission Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2006/0865" id="c00001" Class="EuropeanUnionRegulation" Year="2006" Number="865">(EC) 865/2006</Citation> laying down detailed rules concerning the implementation of Council Regulation (EC) No.<Character Name="NonBreakingSpace"/>338/97 on the protection of species of wild fauna and flora by regulating trade therein<FootnoteRef Ref="f00006"/>.</Text>
</P2para>
</P2>

<Title>EXPLANATORY NOTE</Title>

<P><Text Hanging="indented">These Regulations, which extend to Scotland only, make provision for the registration and ringing or marking of the birds included in Schedule<Character Name="NonBreakingSpace"/>4 to the Wildlife and Countryside Act 1981 (“the Act”) for the purposes of section 7(1) of the Act. Any person who keeps, or has possession of, or control over, one of these birds commits an offence under that subsection if it has not been registered and ringed or marked in accordance with these Regulations.</Text></P>
<P><Text Hanging="indented">These Regulations revoke the Wildlife and Countryside (Registration and Ringing of Certain Captive Birds) Regulations 1982 (“the 1982 Regulations”) (and other instruments which amend the 1982 Regulations) (regulation 7).</Text></P>
<P><Text Hanging="indented">Regulation 3 requires the Scottish Ministers to maintain a register of birds for the purposes of section 7(1) of the Act. It provides that they must not register a bird unless it has been ringed or marked in accordance with regulation 6(1), and that they may decline to do so where any administrative charge has not been paid.</Text></P>
<P><Text Hanging="indented">Regulation 4 sets out the circumstances in which registration ceases to have effect.</Text></P>
<P><Text Hanging="indented">Regulation 5 provides that, where a peregrine falcon or merlin has been registered on the register of birds in respect of which a certificate referred to in Article 10 of Council Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/1997/0338" id="c00002" Class="EuropeanUnionRegulation" Year="1997" Number="0338">(EC) No. 338/97</Citation> on the protection of species of wild fauna and flora by protecting trade therein (“<Term>the Council Regulation</Term>”) has been issued, it is treated as being registered for the purposes of these Regulations.</Text></P>
<P><Text Hanging="indented">Regulation 6 requires that birds to which these Regulations apply be ringed, unless they have been marked in accordance with Article<Character Name="NonBreakingSpace"/>66 of <Citation URI="http://www.legislation.gov.uk/european/regulation/2006/0865" id="c00003" Class="EuropeanUnionRegulation" Year="2006" Number="0865">Commission Regulation (EC) No. 865/2006</Citation> laying down detailed rules concerning the implementation of Council Regulation (EC) No.<Character Name="NonBreakingSpace"/>338/97 on the protection of species of wild fauna and flora by regulating trade therein (“<Term>the Commission Regulation</Term>”).</Text></P>
<P><Text Hanging="indented">Both the Council Regulation and the Commission Regulation implement the Convention on International Trade in Endangered Species of Wild Fauna and Flora.</Text></P>
<P><Text Hanging="indented">A full regulatory impact assessment has been produced for this instrument and a copy of it placed in the Scottish Parliament Information Centre.
