The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 2, 3, and 39(1) of the Planning (Hazardous Substances) (Scotland) Act 19971, sections 8(1)(b) and 16(2)(b) of the Town and Country Planning (Scotland) Act 19972 and all other powers enabling them to do so.
