<Text>The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections<Character Name="NonBreakingSpace"/>16(1), 17(1), 26(1)(a), 31 and 48(1) of the Food Safety Act 1990<FootnoteRef Ref="f00001"/> and all other powers enabling them to do so.</Text></P>
<P>
<Text>In accordance with section<Character Name="NonBreakingSpace"/>48(4A) of that Act the Scottish Ministers have taken into account relevant advice given by the Food Standards Agency<FootnoteRef Ref="f00002"/>.</Text></P>

<P><Text Hanging="indented">These Regulations amend the Natural Mineral Water, Spring Water and Bottled Drinking Water (Scotland) (No.<Character Name="NonBreakingSpace"/>2) Regulations 2007 (“the <Abbreviation Expansion="Natural Mineral Water, Spring Water and Bottled Drinking Water (Scotland) (No. 2) Regulations 2007 (S.S.I. 2007/483)">2007 Regulations</Abbreviation>”) and implement Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2009/0054" id="c00002" Class="EuropeanUnionDirective" Year="2009" Number="54">2009/54/EC</Citation> of the European Parliament and of the Council on the exploitation and marketing of natural mineral waters (Recast) which repeals and re-casts Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1980/0777" id="c00003" Class="EuropeanEconomicCommunityDirective" Year="1980" Number="777">80/777/<Acronym Expansion="European Economic Community">EEC</Acronym></Citation> on the approximation of the laws of the Member States relating to the exploitation and marketing of natural mineral waters.</Text></P>
<P><Text Hanging="indented">The Regulations amend the 2007 Regulations by—</Text><P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>omitting the definition of “Directive 80/777” from paragraph<Character Name="NonBreakingSpace"/>(1) of regulation<Character Name="NonBreakingSpace"/>2 (interpretation) and inserting one of “Directive 2009/54” into that paragraph and amending the definition of “natural mineral water” (regulation<Character Name="NonBreakingSpace"/>3);</Text>

<Text>substituting references to Directive 2009/54 for the references to Directive 80/777 that appear in specified provisions (regulation<Character Name="NonBreakingSpace"/>4);</Text>

<Text>making minor changes to the wording in regulations<Character Name="NonBreakingSpace"/>8(1)(c) and (h) and (4) and 9(2)(c) and of paragraph<Character Name="NonBreakingSpace"/>4 of Schedule<Character Name="NonBreakingSpace"/>4, to reflect minor differences between the provisions of Directive 80/777 which those domestic provisions formerly implemented and the corresponding provisions of Directive 2009/54 (regulations<Character Name="NonBreakingSpace"/>5, 6 and 8(a));</Text>

<Text>substituting, for the provision under which spring water may be transported from spring to bottling plant in containers not for distribution to the ultimate consumer if water from the spring was so transported before 23rd<Character Name="NonBreakingSpace"/>November 1996, one which changes that date to 13th<Character Name="NonBreakingSpace"/>December 1996 (regulation<Character Name="NonBreakingSpace"/>8(b)); and</Text>
