The Smoke Control Areas (Exempt Fireplaces) (Scotland) Order 2009

Coming into force

The Scottish Ministers make the following Order in exercise of the powers conferred by section 21 of the Clean Air Act 19931 and all other powers enabling them to do so.

In accordance with that section, they are satisfied that the classes of fireplace exempted by this Order can be used for burning fuel other than authorised fuels2 without producing any smoke or a substantial quantity of smoke.
