108(1) of, and paragraph 6 of Schedule 1 and paragraph 8 of Schedule 5 to, the National Health Service (Scotland) Act 1978<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/1978/29">1978 c. 29</ref>, section 105(7) was amended by the Health Services Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/1980/53">1980 (c. 53)</ref>, Schedule 6, paragraph 5 and Schedule 7, the Health and Social Services and Social Security Adjudications Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1983/41">1983 (c. 41)</ref> (“the <abbr title="Health and Social Services and Social Security Adjudications Act 1983 c. 41">1983 Act</abbr>”), Schedule 9, paragraph 24 and the Health Act <ref eId="c00005" href="http://www.legislation.gov.uk/id/ukpga/1999/8">1999 (c. 8)</ref>, Schedule 4, paragraph 60; section 108(1) contains definitions of “prescribed” and “regulations” relevant to the exercise of the statutory powers under which these Regulations are made. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act <ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c. 46)</ref>.</p></authorialNote> and all other powers enabling them to do so.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation and commencement</heading><num>1.</num><content><p>These Regulations may be cited as the National Health Service (Appointment of Consultants) (Scotland) Regulations 2009 and come into force on 1st July 2009.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><intro><p>In these Regulations–</p></intro><hcontainer name="definition"><content><p>“<abbr title="National Health Service (Scotland) Act 1978 c. 29">the Act</abbr>” means the National Health Service (Scotland) Act 1978;</p></content></hcontainer><hcontainer name="definition"><content><p>“Board” means a Health Board constituted under section 2(1)(a) of <abbr title="National Health Service (Scotland) Act 1978 c. 29">the Act</abbr><authorialNote class="footnote" eId="f00002" marker="2"><p>Section 2(1)(a) was amended by the <abbr title="Health and Social Services and Social Security Adjudications Act 1983 c. 41">1983 Act</abbr>, section 14(2) and Schedule 7, paragraph 1, the National Health Service and Community Care Act <ref eId="c00007" href="http://www.legislation.gov.uk/id/ukpga/1990/19">1990 (c. 19)</ref> (“the <abbr title="National Health Service and Community Care Act 1990 c. 19">1990 Act</abbr>”), section 28(a)(i) and the <ref eId="c00008" href="http://www.legislation.gov.uk/id/asp/2005/13">Smoking, Health and Social Care (Scotland) Act 2005 (asp 13)</ref> (“the <abbr title="Smoking, Health and Social Care (Scotland) Act 2005 asp 13">2005 Act</abbr>”), section 42(1) and schedule 2, paragraph 2(2).</p></authorialNote> or a Special Health Board constituted under section 2(1)(b) of <abbr title="National Health Service (Scotland) Act 1978 c. 29">the Act</abbr><authorialNote class="footnote" eId="f00003" marker="3"><p>Section 2(1)(b) was inserted by the <abbr title="National Health Service and Community Care Act 1990 c. 19">1990 Act</abbr>, section 28(a)(ii) and amended by the <abbr title="Smoking, Health and Social Care (Scotland) Act 2005 asp 13">2005 Act</abbr>, section 42(1) and schedule 2, paragraph 2(2).</p></authorialNote>, and all references to a “Board” in these Regulations include the Common Services Agency for the Scottish Health Service constituted under section 10 of <abbr title="National Health Service (Scotland) Act 1978 c. 29">the Act</abbr>;</p></content></hcontainer><hcontainer name="definition"><content><p>“consultant post” means a post at the consultant grade in the relevant speciality;</p></content></hcontainer><hcontainer name="definition"><content><p>“hospice” means an institution which provides hospital accommodation wholly or mainly for persons resident who are terminally ill;</p></content></hcontainer><hcontainer name="definition"><content><p>“relevant speciality”, in relation to a proposed appointment, means the branch of medicine or dentistry in which it is proposed to make the appointment;</p></content></hcontainer><hcontainer name="definition"><content><p>“Specialist List” means a list maintained by the General Dental Council in accordance with regulations made by the General Dental Council pursuant to section 26(3) and (4) of the Dentists Act 1984<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00009" href="http://www.legislation.gov.uk/id/ukpga/1984/24">1984 c. 24</ref>.</p></authorialNote>; and</p></content></hcontainer><hcontainer name="definition"><content><p>“Specialist Register” means the register maintained by the General Medical Council pursuant to article 13(1) of the General and Specialist Medical Practice (Education, Training and Qualifications) Order 2003<authorialNote class="footnote" eId="f00005" marker="5"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00010" href="http://www.legislation.gov.uk/id/uksi/2003/1250">2003/1250</ref>.</p></authorialNote>.</p></content></hcontainer></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Appointments to which the regulations apply</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><content><p>Subject to regulation 4, these Regulations apply to appointments to consultant posts on the staff of a Board.</p></content></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><content><p>In making such appointments Boards must have regard to guidance which the Scottish Ministers may from time to time issue.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Appointments to which the regulations do not apply</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><intro><p>These Regulations do not apply to the following appointments–</p></intro><level class="para1" eId="regulation-4-1-a"><num>(a)</num><intro><p>appointment to an honorary consultant post including, in particular, any such appointment of a person who is and will continue to be–</p></intro><level class="para2" eId="regulation-4-1-a-i"><num>(i)</num><content><p>a professor, reader or other member of a medical or dental department of a university;</p></content></level><level class="para2" eId="regulation-4-1-a-ii"><num>(ii)</num><content><p>a research worker for the purposes of whose research it is necessary or expedient that the worker be appointed to the staff of a Board; or</p></content></level><level class="para2" eId="regulation-4-1-a-iii"><num>(iii)</num><content><p>a medical practitioner who is on the staff of a hospice to provide medical services in the hospice;</p></content></level></level><level class="para1" eId="regulation-4-1-b"><num>(b)</num><intro><p>appointment for a period not exceeding–</p></intro><level class="para2" eId="regulation-4-1-b-i"><num>(i)</num><content><p>in the case of an appointment on a locum basis, 12 months; or</p></content></level><level class="para2" eId="regulation-4-1-b-ii"><num>(ii)</num><content><p>in any other case, 2 years;</p></content></level></level></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><content><p>In this regulation–</p><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>“honorary”, in relation to a consultant post, means that the employment in that post is on terms that the holder receives no remuneration for that post; and</p></item><item><p>“remuneration” does not include any distinction award or the defraying of expenses involved in the carrying out of the duties of a hospital appointment.</p></item></blockList></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>External Advisers</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>A Board proposing to make an appointment to which these regulations apply must appoint a person to act as an adviser to the Board throughout the recruitment process, such person to be known as the External Adviser.</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><intro><p>The External Adviser must be–</p></intro><level class="para1" eId="regulation-5-2-a"><num>(a)</num><content><p>named on a list of suitable and trained persons held by or on behalf of the Medical Royal Colleges and Faculties in Scotland;</p></content></level><level class="para1" eId="regulation-5-2-b"><num>(b)</num><content><p>not employed by the Board making the appointment; and</p></content></level><level class="para1" eId="regulation-5-2-c"><num>(c)</num><intro><p>either–</p></intro><level class="para2" eId="regulation-5-2-c-i"><num>(i)</num><content><p>on the Specialist Register kept by the General Medical Council for the relevant speciality or;</p></content></level><level class="para2" eId="regulation-5-2-c-ii"><num>(ii)</num><content><p>on a Specialist List kept by the General Dental Council for the relevant speciality.</p></content></level></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Assessment Panel</heading><num>6.</num><paragraph eId="regulation-6-1"><num>(1)</num><content><p>A Board proposing to make an appointment to which these regulations apply must convene a panel for the purpose of candidate assessment and selection, such panel to be known as the Assessment Panel.</p></content></paragraph><paragraph eId="regulation-6-2"><num>(2)</num><intro><p>Subject to paragraph (3) the Assessment Panel must consist of–</p></intro><level class="para1" eId="regulation-6-2-a"><num>(a)</num><content><p>an officer of the Board who is the Chair;</p></content></level><level class="para1" eId="regulation-6-2-b"><num>(b)</num><content><p>an External Adviser appointed in accordance with regulation 5;
