The Scottish Ministers make the following Order in exercise of the powers conferred by sections 30, 31 and 275 of the Town and Country Planning (Scotland) Act 1997

and all other powers enabling them to do so.

Citation and commencement1.

This Order may be cited as the Town and Country Planning (General Permitted Development) (Avian Influenza) (Scotland) Amendment Order 2008 and comes into force on 26th March 2008.

S.I. 1992/223. Part 25A was inserted into S.I. 1992/223 by S.S.I. 2007/135. There are other amendments to S.I. 1992/223 which are not relevant to this Order

is amended in accordance with paragraph (2).

In Part 25A of Schedule 1 to the Order (temporary protection of poultry and other captive birds), in Class 72A–

(a)

in paragraph (3)(c) for “on or before the relevant date” substitute, “on or as soon as practicable after the relevant date”; and

(b)

in paragraph (4), in the definition of “relevant date” for “2008” substitute, “2009”.
