The Planning etc. (Scotland) Act 2006 (Commencement No. 5) Order 2008
Citation and interpretation1.
(1)
This Order may be cited as the Planning etc. (Scotland) Act 2006 (Commencement No. 5) Order 2008.
(2)
In this Order “the Act” means the Planning etc. (Scotland) Act 2006.
Commencement2.
(1)
Section 52(1) of the Act (regulations in connection with inquiries) comes into force on 12th December 2008.
(2)
The provisions of the Act specified in paragraph (3) to the extent not already in force come into force on 12th December 2008 only for the purpose of enabling orders or regulations to be made.
(3)
The provisions are–
(a)
Part 3 (Development Management);
(b)
Part 4 (Enforcement); and
(c)
section 54(17) (further amendment of the principal Act).

This Order brings section 52(1) of the Planning etc. (Scotland) Act 2006 (“the Act”) into force on 12th December 2008 and Parts 3 and 4 and section 54(17) of the Act into force on that date only for the purposes of enabling orders or regulations to be made.
The following provisions of the Act have been brought into force by commencement orders made before the date of this Order.
