<Title>Definition of microgeneration capacity</Title>

<Pnumber>1</Pnumber>
<P2para>
<Text>In these Regulations, “microgeneration capacity” means the capacity of plant or machinery to generate electricity or to produce heat where–</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>in generating electricity or as the case may be producing heat, the plant or machinery relies wholly or mainly on a source of energy or a technology specified in paragraph (2); and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>the capacity of the plant or machinery to generate electricity or as the case may be to produce heat does not exceed the capacity specified in paragraph (3).</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>The sources of energy and technology referred to in paragraph (1)(a) are–</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>biomass;</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>biofuels;</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>fuel cells;</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>photovoltaics;</Text>
</P3para>
</P3>
<P3>
<Pnumber>e</Pnumber>
<P3para>
<Text>water (including waves and tides);</Text>
</P3para>
</P3>
<P3>
<Pnumber>f</Pnumber>
<P3para>
<Text>wind;</Text>
</P3para>
</P3>
<P3>
<Pnumber>g</Pnumber>
<P3para>
<Text>solar power;</Text>
</P3para>
</P3>

<Pnumber>h</Pnumber>

<Text>geothermal sources;</Text>
</P3para>
</P3>

<Text>heat from air, water or the ground; and</Text>

<Text>combined heat and power systems.</Text>

<Text>The capacity referred to in paragraph (1)(b) is–</Text>

<Text>in relation to the generation of electricity, 50 kilowatts;</Text>

<Text>These Regulations amend the Valuation for Rating (Plant and Machinery) (Scotland) Regulations 2000 (“the principal Regulations”). The principal Regulations prescribe the plant and machinery which is to be assumed to be part of lands and heritages for the purposes of valuation for non-domestic rating.</Text>

<Text>Regulation 2(2) of these Regulations inserts a definition of “microgeneration capacity” into the principal Regulations. Regulation 2(3) to (6) amends the Schedule to the principal Regulations in respect of Classes 1 to 4. To the extent that plant or machinery has microgeneration capacity, it is not relevant for the purposes of valuation.</Text>
