The Scottish Ministers make the following Order in exercise of the powers conferred by section 79(3) and (4) of the Adult Support and Protection (Scotland) Act 20071.
Citation1
This Order may be cited as the Adult Support and Protection (Scotland) Act 2007 (Commencement No. 2 and Transitional Provisions) Amendment Order 2008.
Amendment of the Adult Support and Protection (Scotland) Act 2007 (Commencement No. 2 and Transitional Provisions) Order 20082
For article 2(2) of the Adult Support and Protection (Scotland) Act 2007 (Commencement No. 2 and Transitional Provisions) Order 20082 substitute the following–

The following provisions shall come into force on 1st October 2008–
a
section 74;
b
section 77(2) and Schedule 2 insofar as they relate to section 146 of the Mental Health Act 19833.

The Adult Support and Protection (Scotland) Act 2007 (Commencement No. 1, Transitional Provision and Savings) Order 2007 (S.S.I. 2007/334 (c.28)) provides for commencement of provisions of the 2007 Act as follows:–
