The Registrar General makes the following Regulations in exercise of the powers conferred by sections 39B(1)(b) and (2)(a) and 54(1)(b) of the Registration of Births, Deaths and Marriages (Scotland) Act 1965(1) and all other powers enabling him to do so.
The Scottish Ministers(2) have approved the making of these Regulations in accordance with section 54(1) of that Act.
Citation and commencement
1. These Regulations may be cited as the Registration of Births, Still-births, Deaths and Marriages (Prescription of Forms) (Scotland) Amendment Regulations 2007 and come into force on 14th January 2008.
Notification of deaths to third parties
2. In the Registration of Births, Still-births, Deaths and Marriages (Prescription of Forms) (Scotland) Regulations 1997(3)—
(a)after regulation 17 insert—
“17A. The application prescribed for the purposes of section 39B(1)(4) shall be in the form set out in Schedule 15A.
17B. The notice prescribed for the purposes of section 39B(2) shall be in the form set out in Schedule 15B.”; and
(b)after Schedule 15 insert Schedules 15A and 15B set out in Schedules 1 and 2 to these Regulations.

Explanatory Note
(This note is not part of the Regulations)
These Regulations prescribe an application form for a third party to apply for notification of death and the form of notice that will be used by the Registrar General under the disclosure of death information scheme, as provided for in section 39B of the Registration of Births, Deaths and Marriages (Scotland) Act 1965.
1965 c. 49 (“the 1965 Act”). Section 1 of the 1965 Act contains a definition of “Registrar General” and section 56 contains a definition of “prescribed” relevant to the exercise of the statutory powers under which these Regulations are made.
The functions of the Secretary of State under the 1965 Act were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).

Regulation 39B was added by the Local Electoral Administration and Registration Services (Scotland) Act 2006 (asp 14).
