The Scottish Police Services Authority (Police Support Services) (Modification) Order 2007

The Scottish Ministers make the following Order in exercise of the powers conferred by sections 24(1) and 102 of the Police, Public Order and Criminal Justice (Scotland) Act 2006(1), and all other powers enabling them to do so.

In accordance with section 24(2) of that Act, the Scottish Ministers have consulted the Scottish Police Services Authority, persons whom the Scottish Ministers consider represent the interests of chief constables of police forces and police bodies and such other persons as the Scottish Ministers consider appropriate.

In accordance with section 103(4) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

Citation and commencement

1.  This Order may be cited as the Scottish Police Services Authority (Police Support Services) (Modification) Order 2007 and comes into force on 1st April 2008.

Modification of police support services

2.—(1) Section 3 of the Police, Public Order and Criminal Justice (Scotland) Act 2006 (duty to provide the police support services) is modified as follows.

(2) In subsection (2)–

(a)paragraph (b)(ii) is repealed;

(b)in paragraph (e), after “information” insert “and communications”;

(c)the word “and” following paragraph (e) is repealed; and

(d)after paragraph (f) insert–

  • ; and

    (g)

    the development, provision, procurement, maintenance, management, support and oversight, as appropriate, of information and communications technology systems and equipment for–

    (i)

    police forces; and

    (ii)

    such other persons or organisations as the Authority thinks fit..

(3) For subsection (7) substitute–

(7) In this section, “information and communications technology systems” means systems which utilise a computer, telecommunications, wireless telegraphy, radio or other technology by means of which information or other matter may be recorded or communicated without being reduced to documentary form..

Explanatory Note

(This note is not part of the Order)

This Order modifies section 3 of the Police, Public Order and Criminal Justice (Scotland) Act 2006 (asp 10) which defines the police support services which the Scottish Police Services Authority (“the Authority”) is under a duty to provide.

The Order provides that from 1st April 2008 the Authority will have a duty to provide a new police support service in respect of the development, provision, procurement, maintenance, management, support and oversight, as appropriate, of information and communications technology systems and equipment for police forces and such other persons or organisations as the Authority thinks fit. The Order also makes minor amendments to section 3 which are consequential on the provision of this new duty and substitutes a definition of “information and communications technology systems” for the existing definition of “information technology systems”.
