The Shetland Islands Council have applied for an order under section 33 of the Zetland County Council Act 1974(1):

The Scottish Ministers, in exercise of the powers conferred by section 33 of the Act(2) and of all other powers enabling them in that behalf, hereby make the following Order:
1. This Order may be cited as the Shetland Islands Council (Uyea Sound, Unst) Harbour Jurisdiction Order 2007 and shall come into force on 19th September 2007.
2. In this Order “the Uyea Sound area” means so much of the tidal waters of Uyea Sound as is bounded seawards by an imaginary straight line drawn in an easterly direction from a point at latitude 60°41.25'N, longitude 00°55.16'W to a point at latitude 60°41.14'N, longitude 00°54.38'W and the reference to co-ordinates are references to WGS 84 (ETRS89) datum.
3. The Uyea Sound area is designated as an area within which the Council shall exercise jurisdiction as the harbour authority.
4. The Uyea Sound area shall be deemed for all purposes to be situated within the administrative area of the Council.

Shetland Islands Council exercise jurisdiction as harbour authority under the Zetland County Council Act 1974 in respect of the area specified in Schedule 1 to that Act.
The Order establishes a new harbour area at Uyea Sound, Unst within which the Council shall exercise harbour jurisdiction pursuant to section 6 of the 1974 Act and that area shall be deemed for all purposes to be within the administrative area of the Council.
The applicant for this Order is Shetland Islands Council, Town Hall, Lerwick, Shetland.
1974 c.viii; section 33 was amended by the Shetland Islands Council Order Confirmation Act 1985 (c.xxxii), section 4.
The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
