The Scottish Ministers make the following Order in exercise of the powers conferred by sections 86(1) and (2) and 100(2) of the Protection of Vulnerable Groups (Scotland) Act 2007(1) and all other powers enabling them to do so.

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Disclosure Scotland (Staff Transfer) Order 2007 and comes into force on 1st October 2007.

(2) In this Order “employee reference” means the unique seven digit staff identification number allocated by the Strathclyde Joint Police Board to each member of their staff.

Transfer of staff from Disclosure Scotland to the Scottish Administration

2.  The persons, whose employee references are listed in the Schedule to this Order, shall, on 1st October 2007, transfer to, and become members of the staff of, the Scottish Administration.

Explanatory Note

(This note is not part of the Order)

This Order provides for certain employees of the Strathclyde Joint Police Board (“the Police Board”) to transfer to, and become members of the staff of, the Scottish Administration (meaning the staff of the Scottish Executive and of certain non ministerial office holders). The staff who will transfer are those who work in Disclosure Scotland discharging Scottish Ministers' functions relating to criminal records certificates in terms of Part 5 of the Police Act 1997 (c. 50). The staff are currently employed as civilian (non constable) employees of the Police Board under section 9 of the Police (Scotland) Act 1967 (c. 77). The transfer of the staff takes place on 1st October 2007. The staff are identified in the Schedule (introduced by article 2) according to their employee references. One hundred and one employees of the Police Board will be transferred to the staff of the Scottish Administration.
