Citation 1 This Order may be cited as the Prostitution (Public Places) (Scotland) Act 2007 (Commencement) Order 2007. Appointed day 2 15th October 2007 is the appointed day for the coming into force of sections 1 and 2 of the Prostitution (Public Places) (Scotland) Act 2007. This Order brings into force the Prostitution (Public Places) (Scotland) Act 2007 (“the Act”) on 15th October 2007.

Section 1 of the Act creates new offences of: soliciting in a relevant place (essentially, a public place) for the purpose of obtaining the services of a person engaged in prostitution; and loitering in a relevant place where it can reasonably be inferred that the person loitering was doing so for the purpose of obtaining the services of a person engaged in prostitution.

Section 2 of the Act provides that offences under section 1 are arrestable offences.
