The Aquaculture and Fisheries (Scotland) Act 2007 (Commencement and Transitional Provisions) Order 2007

The Scottish Ministers make the following Order in exercise of the powers conferred by sections 42(1) and 45(2) and (3) of the Aquaculture and Fisheries (Scotland) Act 20071 and all other powers enabling them to do so.
Citation1
This Order may be cited as the Aquaculture and Fisheries (Scotland) Act 2007 (Commencement and Transitional Provisions) Order 2007.
Appointed day2

Subject to the transitional provisions in articles 3 and 4, the appointed day for the coming into force of the provisions of the Aquaculture and Fisheries (Scotland) Act 2007 (“the Act”) (other than sections 12 and 42 to 45) is 1st August 2007, except for section 35.

The appointed day for the coming into force of section 35 is 1st August 2008.
Transitional Provisions

The amendments made by section 32 of the Act to sections 3(3) and 4(7) of the Sea Fisheries (Shellfish) Act 19672 do not apply in relation to a person convicted of an offence entirely committed prior to 1st August 2007.

The amendments made by paragraph (2) of schedule 6 to the Act to section 17 of the Salmon and Freshwater Fisheries (Consolidation) (Scotland) Act 20033 do not apply in relation to an offence entirely committed prior to 1st August 2007.
