The Scottish Ministers in exercise of the powers conferred by sections 26, 70(1), 73(a), 74(a), 105(7) and 108(1) of, and by paragraphs 2 and 2A of Schedule 11 to, the National Health Service (Scotland) Act 19781 and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation, commencement and interpretation1

These Regulations may be cited as the National Health Service (Optical Charges and Payments) (Scotland) Amendment Regulations 2007 and shall come into force on 1st April 2007.

In these Regulations “the principal Regulations” means the National Health Service (Optical Charges and Payments) (Scotland) Regulations 19982.

Amendment of the principal Regulations2

The principal Regulations are amended as follows.

In regulation 1(2) (citation, commencement and interpretation)3

omit the definition of “ophthalmic list”;

in the definition of “Ophthalmic Services Regulations” for “1986” substitute “2006”4; and

c

omit the definition of “the 1989 Regulations”.

Application of regulation 2 of these Regulations3

The amendments made by regulation 2(5) to (8) of, and the Schedule to, these Regulations apply only in relation to a voucher accepted or used pursuant to regulation 12 or regulation 17 of the principal Regulations on or after 1st April 2007.

These Regulations amend the National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 (“the principal Regulations”) which provide for payments to be made by means of a voucher system, in respect of costs incurred by certain categories of persons in connection with the supply, replacement and repair of optical appliances.

Regulation 2(2) amends the definitions in the principal Regulations.

Regulation 2(3) and (4) amends the principal Regulations as a consequence of the consolidation of the National Health Service (Charges for Drugs and Appliances) (Scotland) Regulations and the National Health Service (General Ophthalmic Services) (Scotland) Regulations.

Regulation 2(5) amends the principal Regulations to increase the redemption value of a voucher issued towards the cost of replacement of a single contact lens and to increase the maximum contribution by way of a voucher to the cost of repair of a frame.

Regulation 2(6) amends the principal Regulations to increase the value of vouchers towards the cost of the supply and replacement of optical appliances.

Regulation 2(7) amends the principal Regulations to increase the value of vouchers issued towards the cost of the repair and replacement of optical appliances.

Regulation 2(8) amends the principal Regulations to increase the additional values for vouchers for prisms, tints or photochromic lenses and special categories of appliances.

The increases contained in regulation 2(5) to (8) and the Schedule come into force on 1st April 2007. Regulation 3 provides however that those increases only apply in relation to vouchers accepted or used on or after 1st April 2007.
