These Regulations are made under section 2(2) of the European Communities Act 1972 and section 40 of the Town and Country Planning (Scotland) Act 1997. They implement in Scotland the amendments made by Article 3 of Council Directive 2003/35/EC (the 2003 Directive) (O.J. L 156,25.6.03, p.17-24) with regard to public participation and access to justice to Council Directive 85/337/EEC (the PPD) (O.J. L 175, 5.7.1985, p.40). The following Regulations and Act are amended in the following Parts of the Regulations:Part II – The Environmental Impact Assessment (Scotland) Regulations 1999 (“the 1999 Regulations”);Part III – The Roads (Scotland) Act 1984;Part IV – The Environmental Impact Assessment (Fish Farming in Marine Waters) Regulations; andPart V – The Environmental Impact Assessment (Forestry) (Scotland) Regulations 1999
