This change necessitates the closing of the University as it is currently constituted and establishing a new institution of higher education. 2006 No. 452 EDUCATION The Academic Awards and Distinctions (The Robert Gordon University) (Scotland) Order of Council 2006 Made 4th September 2006 Laid before the Scottish Parliament 11th September 2006 Coming into force 4th October 2006 At the Council Chamber, Whitehall, the 4th day of September 2006 By the Lords of Her Majesty’s Most Honourable Privy Council Their Lordships, in exercise of the powers conferred upon Them by sections 48 and 60(3) of the Further and Higher Education (Scotland) Act 1992 and of all other powers enabling Them in that behalf, order as follows: Citation, commencement and interpretation 1 1 This Order may be cited as the Academic Awards and Distinctions (The Robert Gordon University) (Scotland) Order of Council 2006 and shall come into force on 4th October 2006. 2 In this Order, “the Act” means the Further and Higher Education (Scotland) Act 1992 and “The Robert Gordon University” means the institution of higher education established by the Robert Gordon University (Establishment) (Scotland) Order 2006. Competence to grant academic awards and distinctions 2 1 The Robert Gordon University is specified as competent to grant all such awards and distinctions as may be granted in pursuance of section 48(2) and (3) of the Act. 2 The date specified for the purpose of section 48(2)(a) of the Act in relation to The Robert Gordon University is 4th October 2006. 3 If the name of The Robert Gordon University is changed under section 49 of the Act or under any other power, the competence to grant awards and distinctions arising from the specification in paragraph (1) above shall continue to apply to that institution as renamed. Consequential Amendments 3 In the Academic Awards and Distinctions (Scotland) Order of Council 1992– a insert “and” after article 2(1)(c); and b in article 2(1), omit– ; and The Robert Gordon Institute of Technology . The Robert Gordon University (Establishment) (Scotland) Order 2006 establishes a new institution of higher education to be called The Robert Gordon University (“the new institution”).

On the date of coming into force of the Robert Gordon University (Closure) (Scotland) Order 2006, the University, formerly known as The Robert Gordon Institute of Technology and whose name was changed in accordance with section 49 of the Further and Higher Education (Scotland) Act 1992 by resolution of the Governing Body on 18th March 1992, and consent of the Privy Council on 12th June 1992, will be closed. All property, staff, rights and liabilities will be transferred to the new institution.

This Order specifies the new institution as an institution competent to grant degrees, diplomas, certificates and other academic awards or distinctions, including honorary degrees and degrees to members of staff.

The specification of The Robert Gordon Institute of Technology in the Academic Awards and Distinctions (Scotland) Order of Council 1992 is now revoked.
