The Scottish Ministers, in exercise of the powers conferred by section 2(2) of the European Communities Act 19721 and of all other powers enabling them in that behalf, hereby make the following Regulations:
Citation and commencement1
These Regulations may be cited as the Avian Influenza (Preventive Measures) (Scotland) Amendment Regulations 2006 and shall come into force on 22nd June 2006.
Amendment of the Avian Influenza (Preventive Measures) Regulations 20052
In regulation 2 (interpretation) of the Avian Influenza (Preventive Measures) Regulations 20052 for the definition of “the Commission Decision” substitute–
“the Commission Decision” means Commission Decision 2005/734/EC laying down biosecurity measures to reduce the risk of transmission of highly pathogenic avian influenza caused by Influenza virus A subtype H5N1 from birds living in the wild to poultry and other captive birds and providing for an early detection system in areas at particular risk3 as amended, the last amending instrument being Commission Decision 2006/405/EC4;
