The Private Security Industry Act 2001 (Commencement No. 1) (Scotland) Order 2006

The Scottish Ministers in exercise of the powers conferred by section 26(2) of the Private Security Industry Act 20011, and having consulted the Secretary of State in accordance with section 26(2A)(b) of that Act2, hereby make the following Order:

Citation and extent

This Order may be cited as the Private Security Industry Act 2001 (Commencement No. 1) (Scotland) Order 2006.

This Order extends to Scotland only.

Appointed days3

The day appointed for the coming into force of the following provisions of the Private Security Industry Act is 6th July 2006, for–

a

sections 1 to 5, 7 to 12, 19 and 20 and 22 to 253 and Schedules 1 and 2 4; and

b

sections 155 and 17, but only for the purpose of making regulations and orders.

The Private Security Industry Act 2001 (“the 2001 Act”) was extended to Scotland by virtue of the amendment to section 26 of the Act made by paragraph 12(b) of Schedule 15 to the Serious Organised Crime and Police Act 2005 (“the 2005 Act”). Section 26 of the 2001 Act was also amended by paragraph 12(b) of Schedule 15 to the 2005 Act so as to confer powers on Scottish Ministers to commence the provisions of the 2001 Act by Order.

This Order brings into force for Scotland the provisions of the 2001 Act set out in article 3 on 6th July 2006 to the extent specified
