The Scottish Ministers, in exercise of the powers conferred by section 11(1)(b) and (2) of the Human Tissue (Scotland) Act 2006(1)and of all other powers enabling them in that behalf, hereby make the following Regulations:
Citation, commencement and interpretation
1. These Regulations may be cited as the Human Tissue (Removal of Body Parts by an Authorised Person) (Scotland) Regulations 2006 and shall come into force on 1st September 2006.
Removal of body part by an authorised person
2. A registered medical practitioner may authorise any person, who is not such a practitioner, to carry out the removal of a part of the body of a deceased person for the purposes referred to in section 3(1) of the Human Tissue (Scotland) Act 2006 provided the practitioner is satisfied that the person authorised is sufficiently qualified and trained to perform the operation competently.

Explanatory Note
This note is not part of the Regulations
These Regulations make provision as to a person who may be authorised to remove a part of the body of a deceased person for the purposes of transplantation, research, education or training or audit under section 11(1)(b) of the Human Tissue (Scotland) Act 2006.
Regulation 2 provides that a registered medical practitioner may authorise any person, who is not such a practitioner, to carry out such a removal of a part for the purposes of transplantation, research, education or training or audit provided the practitioner is satisfied that the person authorised is sufficiently qualified and trained to perform the operation competently.
