The Regulation of Care (Fees) (Scotland) Amendment Order 2006
Citation and commencement1.
This Order may be cited as the Regulation of Care (Fees) (Scotland) Amendment Order 2006 and shall come into force on 20th June 2006.

““medium adult placement service” means an adult placement service which employs more than three, but not more than fifteen, whole-time equivalent persons to provide and manage the service;
“other adult placement service” means an adult placement service which is neither a small adult placement service nor a medium adult placement service;
“small adult placement service” means an adult placement service which does not employ more than three whole-time equivalent persons to provide and manage the service;”.

This Order amends the Regulation of Care (Fees) (Scotland) Order 2005 (S.S.I. 2005/97) (“the principal Order”) by prescribing the maximum fees which may be imposed by the Scottish Commission for the Regulation of Care (“the Commission”) in respect of applications for registration or for cancellation of registration of an adult placement service, the annual continuation of any such registration, and applications for variation or removal of a condition of such registration under the Regulation of Care (Scotland) Act 2001 (“the Act”) (article 2(2)). The maximum fees in respect of these matters are set out in the table at article 2(3).
The maximum fee which may be imposed by the Commission in respect of issuing a new certificate of registration under section 24(2)(d) of the Act in respect of an adult placement service will be £77. That amount is already set out in article 3 of the principal Order, and will apply to adult placement services by virtue of the amendments made to the principal Order by this Order.
