The Scottish Ministers, in exercise of the powers conferred on them by section 173(1) to (3) and (5)(a) of the Serious Organised Crime and Police Act 2005(1) and having regard to the definition of “enactment” in section 177(2) of that Act, hereby make the following Order:

(1)

2005 c. 15. By virtue of section 173(5)(a) of that Act, the power conferred on the Secretary of State by section 173(1) is exercisable by the Scottish Ministers (rather than by the Secretary of State) where the provision to be made is for the general purposes of that Act and would be within the legislative competence of the Scottish Parliament if it were included in an Act of the Scottish Parliament.
