The Water Environment (Drinking Water Protected Areas) (Scotland) Order 2005

The Scottish Ministers, in exercise of the powers conferred by sections 6(1) and (2) of the Water Environment and Water Services (Scotland) Act 20031 and of all other powers enabling them in that behalf, hereby make the following Order:

Citation, commencement and interpretation1

This Order may be cited as the Water Environment (Drinking Water Protected Areas) (Scotland) Order 2005 and shall come into force on 22nd March 2005.

In this Order any reference to a section is a reference to that section of the Water Environment and Water Services (Scotland) Act 2003.

Drinking Water Protected Areas2

The bodies of surface water identified in maps 1 to 112, and the bodies of groundwater identified in maps 12 to 22(b) are for the purposes of section 6(1), those bodies of water in the Scotland River Basin District3 which are–

a

used for the abstraction of water intended for human consumption and either–

i

provide more than 10 cubic metres of such water per day, or

ii

serve more than 50 persons, or

b

are intended to be used as mentioned in paragraph (a).

The maps referred to in paragraph (1) are the maps prepared for the purposes of this Order and laid before the Scottish Parliament in accordance with section 6(2).

This Order identifies those bodies of water used for the abstraction of drinking water, as required by section 6(1) of the Water Environment and Water Services (Scotland) Act 2003.

This is done by reference to maps prepared for the purposes of the Order and laid before the Scottish Parliament in accordance with section 6(2) of the Act.

The maps identify the bodies of surface water and bodies of groundwater in the Scotland River Basin District which are used for the abstraction of drinking water and either provide more than 10 cubic metres per day, or serve more than 50 persons, or are intended for such use.

The Order and maps will be published by the Scottish Ministers and will be available on their website at www.scotland.gov.uk.
