Subject to paragraph (2), the provisions of this Part shall apply to plant pests and relevant material which are introduced into Scotland from a third country either directly or via another part of the European Community.

The provisions of this Part shall only apply to EC transit goods in respect of which the Scottish Ministers have agreed with the official body of point of entry for those goods, in accordance with article 12(6), to be responsible for certain matters.
