The function conferred on a Minister of the Crown under section 2(2) of the 1972 Act, so far as within devolved competence, was transferred to the Scottish Ministers by section 53 of the <abbr title="Scotland Act 1998 c. 46">1998 Act</abbr>. In so far as not so transferred and in so far as relating to food (including drink) including the primary production of food, that function was transferred to the Scottish Ministers by the Scotland Act 1998 (Transfer of Functions to the Scottish Ministers <abbr title="et cetera" xml:lang="la">etc.</abbr>) Order 2005 (<abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00038" href="http://www.legislation.gov.uk/id/uksi/2005/849">2005/849</ref>).</p></authorialNote>, and of all other powers enabling them in that behalf, after consultation as required by Article 9 of Regulation <ref eId="c00001" href="http://www.legislation.gov.uk/european/regulation/2002/0178">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 178/2002</ref> of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety<authorialNote class="footnote" eId="f00002" marker="2"><p>O.J. <abbr title="Number">No.</abbr> L 31, 1.2.02, p.1, as last amended by Regulation <ref eId="c00039" href="http://www.legislation.gov.uk/european/regulation/2003/1642">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 1642/2003</ref> (O.J. <abbr title="Number">No.</abbr> L 245, 29.9.03, p.4).</p></authorialNote>, hereby make the following Regulations:</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation, commencement and extent</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Meat (Official Controls Charges) (Scotland) Regulations 2005 and shall come into force on 1st January 2006.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations extend to Scotland only.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><intro><p>In these Regulations–</p></intro><hcontainer name="definition"><content><p>“accounting period” means a period of less than a year determined by the Agency;</p></content></hcontainer><hcontainer name="definition"><content><p>“the Agency” means the Food Standards Agency;</p></content></hcontainer><hcontainer name="definition"><intro><p>“agreed slaughterhouse staff costs” means, in respect of any slaughterhouse at which poultry or lagomorphs are slaughtered–</p></intro><level class="para1"><num>(a)</num><content><p>the proportion (expressed as a sum of money) of the salaries (including overtime payments and employers' pension contributions and employers' National Insurance contributions) paid to the staff at that slaughterhouse, in respect of an accounting period, which the Agency and the operator of the slaughterhouse agree as being attributable to any such staff assisting with official controls by carrying out certain tasks there during that period under Article 5.6 of Regulation 854/2004; plus</p></content></level><level class="para1"><num>(b)</num><content><p>25% of that sum;</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“cutting plant” means an establishment which is used for boning and/or cutting up fresh meat for placing on the market and which–</p></intro><level class="para1"><num>(a)</num><content><p>is approved or conditionally approved under Article 31.2 of Regulation 882/2004; or</p></content></level><level class="para1"><num>(b)</num><content><p>(although lacking the approval or conditional approval that it requires under Article 4.3 of Regulation 853/2004) was, on 31st December 2005, licensed as cutting premises under the Fresh Meat (Hygiene and Inspection) Regulations 1995<authorialNote class="footnote" eId="f00003" marker="3"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00040" href="http://www.legislation.gov.uk/id/uksi/1995/539">1995/539</ref>, revoked with effect from 1st January 2006 by <ref eId="c00041" href="http://www.legislation.gov.uk/id/ssi/2005/505">S.S.I. 2005/505</ref>.</p></authorialNote> or the Poultry Meat, Farmed Game Bird Meat and Rabbit Meat (Hygiene and Inspection) Regulations 1995<authorialNote class="footnote" eId="f00004" marker="4"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00042" href="http://www.legislation.gov.uk/id/uksi/1995/540">1995/540</ref>, revoked with effect from 1st January 2006 by <ref eId="c00043" href="http://www.legislation.gov.uk/id/ssi/2005/505">S.S.I. 2005/505</ref>.</p></authorialNote>;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“cutting up” has the meaning it bears in Regulation 853/2004 and “cut up” shall be construed accordingly;</p></content></hcontainer><hcontainer name="definition"><content><p>“Directive 2004/41”, “Regulation 178/2002”, Regulation 852/2004”, “Regulation 853/2004”, “Regulation 854/2004”, “Regulation 882/2004” and “Regulation 1688/2005” have the meanings respectively given to them in Schedule 1;</p></content></hcontainer><hcontainer name="definition"><content><p>“employers' National Insurance contributions” means those social security contributions for which employers are liable under Part I of the Social Security Contributions and Benefits Act 1992<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00044" href="http://www.legislation.gov.uk/id/ukpga/1992/4">1992 c. 4</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“establishment” has the meaning given to it in Article 2.1(c) of Regulation 852/2004;</p></content></hcontainer><hcontainer name="definition"><content><p>“food business operator” has the meaning given to it in Article 3.3 of Regulation 178/2002;</p></content></hcontainer><hcontainer name="definition"><intro><p>“game-handling establishment” means any establishment in which game and game meat obtained after hunting are prepared for placing on the market and which–</p></intro><level class="para1"><num>(a)</num><content><p>is approved or conditionally approved under Article 31.2 of Regulation 882/2004; or</p></content></level><level class="para1"><num>(b)</num><content><p>(although lacking the approval or conditional approval that it requires under Article 4.3 of Regulation 853/2004) was, on 31st December 2005, licensed as a wild game processing facility under the Wild Game (Hygiene and Inspection) Regulations 1995<authorialNote class="footnote" eId="f00006" marker="6"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00045" href="http://www.legislation.gov.uk/id/uksi/1995/2148">1995/2148</ref>, revoked with effect from 1st January 2006 by <ref eId="c00046" href="http://www.legislation.gov.uk/id/ssi/2005/505">S.S.I. 2005/505</ref>.</p></authorialNote>;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“game meat” has the meaning that it bears in Regulation 853/2004;</p></content></hcontainer><hcontainer name="definition"><content><p>“lagomorph” shall be construed in accordance with the definition of the term “lagomorphs” in point 1.4 of Annex I to Regulation 853/2004;</p></content></hcontainer><hcontainer name="definition"><content><p>“meat” has the meaning given to it in point 1.1 of Annex I to Regulation 853/2004;</p></content></hcontainer><hcontainer name="definition"><intro><p>“official controls” means the controls that the Agency performs under Regulation 854/2004 for the verification of compliance with–</p></intro><level class="para1"><num>(a)</num><content><p>Articles 3, 4.1(a), 5, 7 and (save insofar as it relates to minced meat and eggs) 8 of Regulation 853/2004; and</p></content></level><level class="para1"><num>(b)</num><content><p>the requirements of the Welfare of Animals (Slaughter or Killing) Regulations 1995<authorialNote class="footnote" eId="f00007" marker="7"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00047" href="http://www.legislation.gov.uk/id/uksi/1995/731">1995/731</ref>, amended by <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00048" href="http://www.legislation.gov.uk/id/uksi/1999/400">1999/400</ref> and <ref eId="c00049" href="http://www.legislation.gov.uk/id/uksi/1999/1820">1820</ref>, <ref eId="c00050" href="http://www.legislation.gov.uk/id/ssi/2000/62">S.S.I. 2000/62</ref>, <ref eId="c00051" href="http://www.legislation.gov.uk/id/ssi/2001/73">2001/73</ref> and <ref eId="c00052" href="http://www.legislation.gov.uk/id/ssi/2001/145">145</ref>, <ref eId="c00053" href="http://www.legislation.gov.uk/id/ssi/2002/238">2002/238</ref> and <ref eId="c00054" href="http://www.legislation.gov.uk/id/ssi/2002/255">255</ref> and <ref eId="c00055" href="http://www.legislation.gov.uk/id/ssi/2004/13">2004/13</ref>.</p></authorialNote> insofar as such verification relates to the welfare of animals slaughtered for human consumption in slaughterhouses;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“official controls charge” means the charge calculated in accordance with Schedule 2 to these Regulations and notified in accordance with regulation 3(1), (2) or (3) of these Regulations;</p></content></hcontainer><hcontainer name="definition"><content><p>“operator” means a food business operator who is carrying on the business of a slaughterhouse, game-handling establishment or cutting plant or that operator’s duly authorised representative;</p></content></hcontainer><hcontainer name="definition"><content><p>“placing on the market” has the meaning given to it in Article 3.8 of Regulation 178/2002;</p></content></hcontainer><hcontainer name="definition"><content><p>“poultry” has the meaning given to it in point 1.3 of Annex I to Regulation 853/2004;</p></content></hcontainer><hcontainer name="definition"><content><p>“premises” means any slaughterhouse, game-handling establishment or cutting plant;</p></content></hcontainer><hcontainer name="definition"><intro><p>“slaughterhouse” means an establishment used for slaughtering and dressing animals, the meat of which is intended for human consumption and which–</p></intro><level class="para1"><num>(a)</num><content><p>is approved or conditionally approved under Article 31.2 of Regulation 882/2004; or</p></content></level><level class="para1"><num>(b)</num><content><p>(although lacking the approval or conditional approval that it requires under Article 4.3 of Regulation 853/2004) was, on 31st December 2005, licensed as a slaughterhouse under the Fresh Meat (Hygiene and Inspection) Regulations 1995 or the Poultry Meat, Farmed Game Meat and Rabbit Meat (Hygiene and Inspection) Regulations 1995; and</p></content></level></hcontainer><hcontainer name="definition"><content><p>“verification” means checking, by examination and the provision of objective evidence.</p></content></hcontainer></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Charges</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><content><p>The Agency shall, subject to the following provisions of this regulation, notify the operator of each slaughterhouse, game-handling establishment and cutting plant in which official controls have been exercised in any accounting period of an official controls charge in respect of those official controls as soon as practicable after the end of that period.</p></content></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><content><p>Where the Agency cannot comply with paragraph (1) because it has insufficient information available to it to enable it to calculate the official controls charge for any accounting period in respect of any such premises as are specified in that paragraph, it shall notify the operator of those premises of an interim charge, being such amount as the Agency estimates (having regard to the information it has) the official controls charge to be.</p></content></paragraph><paragraph eId="regulation-3-3"><num>(3)</num><intro><p>Where the Agency has notified an operator of an interim charge in accordance with paragraph (2), and sufficient information becomes available to the Agency to calculate the official controls charge, it shall calculate that charge and–</p></intro><level class="para1" eId="regulation-3-3-a"><num>(a)</num><content><p>where it exceeds the interim charge, notify the operator of the final charge, being the amount by which the official controls charge exceeds the interim charge; or</p></content></level><level class="para1" eId="regulation-3-3-b"><num>(b)</num><content><p>subject to paragraph (6), where it is less than the interim charge, credit to the operator the amount by which the interim charge exceeds the official controls charge.</p></content></level></paragraph><paragraph eId="regulation-3-4"><num>(4)</num><content><p>Any charge notified to an operator under paragraph (1), (2) or (3) shall be payable by the occupier to the Scottish Ministers and shall be recoverable on demand by the Scottish Ministers, or by the Agency acting on their behalf, as a debt from the occupier concerned.</p></content></paragraph><paragraph eId="regulation-3-5"><num>(5)</num><content><p>Where any slaughterhouse staff costs have been used to calculate a charge falling to be notified under paragraph (1), (2) or (3), those costs shall be set off against the amount of that charge in determining the actual charge notified thereunder, provided that the amount so set off shall not exceed the charge as originally calculated.</p></content></paragraph><paragraph eId="regulation-3-6"><num>(6)</num><content><p>Where under paragraph (3)(b) a sum is to be credited to an operator, the Scottish Ministers or the Agency acting on their behalf may, if they so determine, pay such sum to the operator concerned instead of crediting it to the operator.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Withdrawal of official controls</heading><num>4.</num><content><p>Where the Scottish Ministers, or the Agency acting on their behalf, have obtained decree against an operator of any premises for any sum which is payable to the Scottish Ministers under regulation 3(4) and the operator fails within a reasonable time thereafter to comply with that decree, the Scottish Ministers may (without prejudice to any other legal remedy open to them) direct the Agency not to exercise any further official controls at those premises in respect of which the debt accrued until the debt has been satisfied.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Information</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><intro><p>Any person shall on demand being made by the Agency, supply–</p></intro><level class="para1" eId="regulation-5-1-a"><num>(a)</num><content><p>such information as the Agency may reasonably require for the purpose of calculating the official controls charge or notifying an operator of it; and</p></content></level><level class="para1" eId="regulation-5-1-b"><num>(b)</num><content><p>such evidence as the Agency may reasonably require to enable it to verify information supplied under sub-paragraph (a) of this paragraph.</p></content></level></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><intro><p>Any person who–</p></intro><level class="para1" eId="regulation-5-2-a"><num>(a)</num><content><p>in purported compliance with paragraph (1), knowingly or recklessly furnishes information which is false or misleading in a material particular; 2</p></authorialNote></num><heading>CALCULATION OF THE OFFICIAL CONTROLS CHARGE</heading><hcontainer name="crossheading" class="schGroup7"><heading>The official controls charge</heading><paragraph eId="schedule-2-paragraph-1" class="schProv1"><num>1.</num><intro><p>Subject to paragraphs 2 and 3, the official controls charge payable by the operator of any premises for any accounting period shall be the lower of–</p></intro><level class="para1" eId="schedule-2-paragraph-1-a"><num>(a)</num><intro><p>the sum of–</p></intro><level class="para2" eId="schedule-2-paragraph-1-a-i"><num>(i)</num><content><p>the standard charge incurred in relation to those premises for that period, and</p></content></level><level class="para2" eId="schedule-2-paragraph-1-a-ii"><num>(ii)</num><content><p>any additional charge incurred in relation to those premises for that period by virtue of paragraph 8; and</p></content></level></level><level class="para1" eId="schedule-2-paragraph-1-b"><num>(b)</num><content><p>the time costs generated by those premises for that period.</p></content></level></paragraph><paragraph eId="schedule-2-paragraph-2" class="schProv1"><num>2.</num><subparagraph eId="schedule-2-paragraph-2-1"><num>(1)</num><content><p>This paragraph applies where the official controls charge calculated under paragraph 1 for any accounting period (amount A), when added to the official controls charge payable in respect of all earlier accounting periods falling within the same financial period (amount B), produces a total (amount C) which is greater than the amount of the official controls charge which would be payable under paragraph 1 if those accounting periods were one accounting period (amount D).</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-2-2"><num>(2)</num><content><p>Where this paragraph applies, the official controls charge payable by an operator for an accounting period shall be the amount by which amount D exceeds amount B.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-2-3"><num>(3)</num><content><p>In this paragraph “financial period” means a period commencing on the Monday immediately following the last Sunday in March in any year and ending on the last Sunday in March in the following year.</p></content></subparagraph></paragraph><paragraph eId="schedule-2-paragraph-3" class="schProv1"><num>3.</num><content><p>The official controls charge payable by the operator of a slaughterhouse, game-handling establishment or cutting plant for any accounting period shall not be lower than 45% of the standard charge incurred in relation to those premises for that period.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>The standard charge</heading><paragraph eId="schedule-2-paragraph-4" class="schProv1"><num>4.</num><content><p>The standard charge for any accounting period (expressed in Euro) payable by the operator of a slaughterhouse shall be calculated by multiplying the rate given in the following Table applicable to animals of a particular type by the number of animals of that type slaughtered or as the case may be dressed there during that period.</p></content></paragraph><paragraph eId="schedule-2-paragraph-5" class="schProv1"><num>5.</num><content><p>The standard charge for any accounting period (expressed in Euro) payable by the operator of a game-handling establishment in respect of wild game dressed there during that period shall be calculated by multiplying the rate given in the following Table applicable to animals of a eId="schedule-2-paragraph-6" class="schProv1"><num>6.</num><content><p>The standard charge for any accounting period (expressed in Euro) payable by the operator of a cutting plant or of a game-handling establishment in relation to meat cut up or boned there shall be calculated by multiplying by 3 the number of tonnes of meat brought into the plant or establishment concerned during that period.</p></content></paragraph><paragraph eId="schedule-2-paragraph-7" class="schProv1"><num>7.</num><content><p>The standard charge (expressed in Euro) shall be converted into sterling by multiplying it by the Euro/Sterling conversion rate applicable in the year the official control was carried out.</p></content></paragraph><paragraph eId="schedule-2-paragraph-8" class="schProv1"><num>8.</num><subparagraph eId="schedule-2-paragraph-8-1"><num>(1)</num><content><p>Where in respect of an accounting period the Agency incurs increased costs because of inefficiency in the operation of premises, it may, in accordance with this paragraph, add an additional charge to the standard charge incurred in relation to the premises for that period.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-8-2"><num>(2)</num><content><p>The additional charge shall be a sum equal to the time costs generated by the inefficiency for the accounting period concerned.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-8-3"><num>(3)</num><content><p>The Agency may not make an additional charge in accordance with this paragraph unless it has notified the operator of its intention to do so.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-8-4"><num>(4)</num><content><p>The notification referred to in sub-paragraph (3) shall be given as soon as is practicable after the Agency has concluded that it wishes to make an additional charge in accordance with this paragraph.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-8-5"><num>(5)</num><intro><p>For the purposes of this paragraph “inefficiency” means inefficiency on the part of the operator and shall include in particular–</p></intro><level class="para1" eId="schedule-2-paragraph-8-5-a"><num>(a)</num><content><p>delay in the start of slaughtering attributable to the operator;</p></content></level><level class="para1" eId="schedule-2-paragraph-8-5-b"><num>(b)</num><content><p>mechanical breakdown caused by lack of maintenance;</p></content></level><level class="para1" eId="schedule-2-paragraph-8-5-c"><num>(c)</num><content><p>enforcement action taken by the Agency or an inspector;</p></content></level><level class="para1" eId="schedule-2-paragraph-8-5-d"><num>(d)</num><content><p>under-employment of inspectors caused by the operator’s failure to adhere to the working hours or working practices agreed for the purposes of this paragraph pursuant to sub paragraph (6);</p></content></level><level class="para1" eId="schedule-2-paragraph-8-5-e"><num>(e)</num><content><p>insufficient provision of slaughter staff caused by the operator’s failure to adhere to the working hours or working practices agreed for the purposes of this paragraph pursuant to sub-paragraph (6);</p></content></level><level class="para1" eId="schedule-2-paragraph-8-5-f"><num>(f)</num><content><p>delays caused by risks to the health or safety of inspectors attributable to the operator; and</p></content></level><level class="para1" eId="schedule-2-paragraph-8-5-g"><num>(g)</num><content><p>any change to the working hours or working practices agreed for the purposes of this paragraph pursuant to sub-paragraph (6) which is attributable to the operator.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-8-6"><num>(6)</num><content><p>For the purposes of sub-paragraph (5)(d), (e) and (g), the Agency and the operator shall agree working hours and working practices and shall keep the working hours and working practices so agreed under review.</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-8-7"><num>(7)</num><content><p>Where, following any such review, it appears to the Agency and the operator that it is appropriate to do so, they may by further agreement vary any working hours or working practices agreed pursuant to sub-paragraph (6).</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-8-8"><num>(8)</num><content><p>Where any working hours or working practices have been varied pursuant to sub paragraph (7) they shall be treated as having been agreed pursuant to sub-paragraph (6).</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-8-9"><num>(9)</num><content><p>No additional charge may be made in accordance with this paragraph in respect of any increased costs incurred because of any variation in working hours or working practices which does not alter the working hours or working practices which have been agreed in accordance with sub-paragraph (6).</p></content></subparagraph></paragraph><paragraph eId="schedule-2-paragraph-9" class="schProv1"><num>9.</num><subparagraph eId="schedule-2-paragraph-9-1"><num>(1)</num><content><p>An operator who does not agree that an additional charge is justified under paragraph 8 may request that the question be determined by a person nominated for the purpose pursuant to sub-paragraph (3)(a).</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-9-2"><num>(2)</num><content><p>A request under sub-paragraph (1) shall be made within 1 week of the Agency giving the operator notice under paragraph 8(3).</p></content></subparagraph><subparagraph eId="schedule-2-paragraph-9-3"><num>(3)</num><intro><p>Where an operator makes a request under sub-paragraph (1)–</p></intro><level class="para1" eId="schedule-2-paragraph-9-3-a"><num>(a)</num><content><p>the Agency shall nominate a person to determine the question from the list established under sub-paragraph (4);</p></content></level><level class="para1" eId="schedule-2-paragraph-9-3-b"><num>(b)</num><content><p>the person so nominated shall give the operator and the Agency an opportunity to make representations on the question to be determined;</p></content></level><level class="para1" eId="schedule-2-paragraph-9-3-c"><num>(c)</num><content><p>the person so nominated shall, within 1 month of being nominated, decide whether an additional charge is payable and shall notify the operator and the Agency of that decision;</p></content></level><level class="para1" eId="schedule-2-paragraph-9-3-d"><num>(d)</num><content><p>the decision notified under sub-paragraph (c) shall be binding on the operator and the Agency; and</p></content></level><level class="para1" eId="schedule-2-paragraph-9-3-e"><num>(e)</num><content><p>the Agency shall give effect to the decision so notified.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-9-4"><num>(4)</num><content><p>The Agency shall establish and maintain a list of people who may be nominated for the purposes of this paragraph and shall consult those organisations appearing to represent operators before including any person on the list.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Time costs</heading><paragraph eId="schedule-2-paragraph-10" class="schProv1"><num>10.</num><intro><p>The time costs in relation to any premises in any accounting period shall (subject to paragraphs 11 and 12) be calculated by–</p></intro><level class="para1" eId="schedule-2-paragraph-10-a"><num>(a)</num><content><p>multiplying the time (expressed in hours and fractions of an hour) spent by each inspector exercising official controls at those premises in the period by the hourly rate applicable to that inspector determined or varied in accordance with paragraphs 13 to 16;</p></content></level><level class="para1" eId="schedule-2-paragraph-10-b"><num>(b)</num><content><p>adding the results together; and</p></content></level><level class="para1" eId="schedule-2-paragraph-10-c"><num>(c)</num><content><p>adding any agreed slaughterhouse staff costs for that period.</p></content></level></paragraph><paragraph eId="schedule-2-paragraph-11" class="schProv1"><num>11.</num><content><p>The time costs in respect of any official controls shall include any overtime payments or other similar allowances made to the inspector concerned under that person’s contract of employment or contract for services for exercising those official controls.</p></content></paragraph><paragraph eId="schedule-2-paragraph-12" class="schProv1"><num>12.</num><intro><p>In determining the total time spent in exercising official controls, any time spent by an inspector–</p></intro><level class="para1" eId="schedule-2-paragraph-12-a"><num>(a)</num><content><p>in travelling to or from premises at which that person exercises official controls and for which that person is paid under a contract of employment or contract for services;</p></content></level><level class="para1" eId="schedule-2-paragraph-12-b"><num>(b)</num><content><p>at any premises to which that person has gone for the purpose of exercising official controls and for which that person is paid under a contract of employment or contract for services (regardless of whether or not that person is able to exercise official controls there); and</p></content></level><level class="para1" eId="schedule-2-paragraph-12-c"><num>(c)</num><intro><p>at any other place–</p></intro><level class="para2" eId="schedule-2-paragraph-12-c-i"><num>(i)</num><content><p>when that person is available for exercising official controls but is not in fact exercising any such controls, and</p></content></level><level class="para2" eId="schedule-2-paragraph-12-c-ii"><num>(ii)</num><content><p>for which payment is made under that person’s contract of employment or contract for services,</p></content></level><wrapUp><p>shall be counted as if it were time when the inspector was exercising official controls.</p></wrapUp></level></paragraph><paragraph eId="schedule-2-paragraph-13" class="schProv1"><num>13.</num><content><p>The Agency shall determine the hourly rate applicable to inspectors, and may determine different rates for different inspectors or different classes of inspector, having regard to the level of qualifications and experience of different inspectors or classes of inspector and to the cost of exercising official controls by different inspectors or classes of inspector.</p></content></paragraph><paragraph eId="schedule-2-paragraph-14" class="schProv1"><num>14.</num><intro><p>The hourly rate for any inspector or class of inspector shall be calculated so as to reflect–</p></intro><level class="para1" eId="schedule-2-paragraph-14-a"><num>(a)</num><content><p>the mean salary costs and fees (including employers' pension contributions and employers' National Insurance contributions, but excluding any additional costs taken into account pursuant to paragraph 11) and other costs of providing official controls by that inspector or class of inspector; and</p></content></level><level class="para1" eId="schedule-2-paragraph-14-b"><num>(b)</num><content><p>such proportion of the administrative costs of the exercise of official controls as the Agency considers it proper to apportion to that hourly rate.</p></content></level></paragraph><paragraph eId="schedule-2-paragraph-15" class="schProv1"><num>15.</num><intro><p>For the purposes of paragraph 14(b), “administrative costs” means all costs reasonably incurred in exercising official controls including in particular the costs of–</p></intro><level class="para1" eId="schedule-2-paragraph-15-a"><num>(a)</num><content><p>post-qualification training given to inspectors of a particular class in relation to the performance of their functions as a member of that class;</p></content></level><level class="para1" eId="schedule-2-paragraph-15-b"><num>(b)</num><content><p>the salaries (including the cost of overtime, and employers' pension contributions and employers' National Insurance contributions) of the staff other than inspectors engaged in the exercise of official controls, and such proportion of inspectors' remuneration as is not directly accounted for in the calculation of time costs;</p></content></level><level class="para1" eId="schedule-2-paragraph-15-c"><num>(c)</num><content><p>providing office accommodation, equipment and services in relation to the exercise of official controls, including depreciation of any office furniture and equipment and also of providing information technology, stationery and forms;</p></content></level><level class="para1" eId="schedule-2-paragraph-15-d"><num>(d)</num><content><p>protective clothing and equipment used in exercising official controls and of laundering such clothing;</p></content></level><level class="para1" eId="schedule-2-paragraph-15-e"><num>(e)</num><content><p>accounting and collecting charges and of providing pay-roll and personnel services in connection with the employment of inspectors; and</p></content></level><level class="para1" eId="schedule-2-paragraph-15-f"><num>(f)</num><intro><p>other expenses and overheads incurred by or in relation to–</p></intro><level class="para2" eId="schedule-2-paragraph-15-f-i"><num>(i)</num><content><p>inspectors exercising official controls, and</p></content></level><level class="para2" eId="schedule-2-paragraph-15-f-ii"><num>(ii)</num><content><p>other staff engaged in the administration of those controls.</p></content></level></level></paragraph><paragraph eId="schedule-2-paragraph-16" class="schProv1"><num>16.</num><content><p>The Agency may vary any rate determined pursuant to paragraph 13 where, having regard to the factors set out in paragraphs 14 and 15, it appears to it to be necessary to do so.</p></content></paragraph><paragraph eId="schedule-2-paragraph-17" class="schProv1"><num>17.</num><content><p>Prior to determining or varying hourly rates in accordance with paragraphs 13 to 16, the Agency shall consult such operators as are likely to be affected by those rates.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Definitions</heading><paragraph eId="schedule-2-paragraph-18" class="schProv1"><num>18.</num><subparagraph eId="schedule-2-paragraph-18-1"><num>(1)</num><intro><p>In this Schedule–</p></intro><level class="para1" eId="schedule-2-paragraph-18-1-a"><num>(a)</num><content><p>“official auxiliary” and “official veterinarian” have the meanings respectively given to them in Article 2.1(h) and (f) of Regulation 854/2004;</p></content></level><level class="para1" eId="schedule-2-paragraph-18-1-b"><num>(b)</num><content><p>“inspector” means an official veterinarian or an official auxiliary;</p></content></level><level class="para1" eId="schedule-2-paragraph-18-1-c"><num>(c)</num><content><p>“the standard charge” means, in relation to any slaughterhouse, game-handling establishment or cutting plant for any accounting period, the charge calculated in accordance with paragraph 4, 5 or 6, as the case may be, converted into Sterling in accordance with paragraph 7;</p></content></level><level class="para1" eId="schedule-2-paragraph-18-1-d"><num>(d)</num><intro><p>“the Euro/Sterling conversion rate” applicable in respect of any given year is–</p></intro><level class="para2" eId="schedule-2-paragraph-18-1-d-i"><num>(i)</num><content><p>for 2006, 1 Euro = £0.68290, and</p></content></level><level class="para2" eId="schedule-2-paragraph-18-1-d-ii"><num>(ii)</num><content><p>in each subsequent year, the rate published in the C Series of the Official Journal of the European Communities on the first working day of the September of the preceding year or, if no rate is published in it on that day, the first rate published in it thereafter;</p></content></level></level><level class="para1" eId="schedule-2-paragraph-18-1-e"><num>(e)</num><content><p>“time costs” means, in relation to any establishment for any accounting period, the costs calculated in accordance with paragraphs 10 to 12; and</p></content></level><level class="para1" eId="schedule-2-paragraph-18-1-f"><num>(f)</num><content><p>“wild game” has the meaning given to it in point 1.5 of Annex I to Regulation 853/2004.</p></content></level></subparagraph><subparagraph eId="schedule-2-paragraph-18-2"><num>(2)</num><content><p>Expressions used in this Schedule, other than those defined in sub-paragraph (1), which are used in Council Directive <ref eId="c00015" href="http://www.legislation.gov.uk/european/directive/1985/0073">85/73/<abbr class="acronym" title="European Economic Community">EEC</abbr></ref> on the financing of veterinary inspections and controls covered by Directives <ref eId="c00016" href="http://www.legislation.gov.uk/european/directive/1989/0662">89/662/<abbr class="acronym" the revised text of Regulation <ref eId="c00033" href="http://www.legislation.gov.uk/european/regulation/2004/0854">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 854/2004</ref> is now set out in a Corrigendum, O.J. <abbr title="Number">No.</abbr> L 226, 25.6.04, p.83).</p></blockContainer><blockContainer ukl:Name="P"><p>In the light of the modification to Council Directive <ref eId="c00034" href="http://www.legislation.gov.uk/european/directive/1985/0073">85/73/<abbr class="acronym" title="European Economic Community">EEC</abbr></ref> described above, these Regulations implement the provisions of that Directive that now require fees to be collected for inspections of and controls on meat of domestic ungulates, meat from poultry and lagomorphs, meat of farmed game and wild game meat under Regulation <ref eId="c00035" href="http://www.legislation.gov.uk/european/regulation/2004/0854">(<abbr class="acronym" title="European Community">EC</abbr>) <abbr title="Number">No.</abbr> 854/2004</ref>.</p></blockContainer><blockContainer ukl:Name="P"><p>These Regulations–</p><blockContainer ukl:Name="P3" class="para1"><num>(a)</num><p>require the Food Standards Agency (“the Agency”) to notify the operator of each slaughterhouse, game-handling establishment and cutting plant in which official controls have been exercised of the official controls charge that has arisen in relation to those officials controls (the terms “slaughterhouse”, “game-handling establishment”, “cutting plant”, “official controls” and “official controls charge” are all defined in regulation 2) (regulation 3);</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(b)</num><p>provide that any official controls charge so notified is payable by the operator to the Scottish Ministers on demand or to the Agency on their behalf (regulation 3(4));</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(c)</num><p>allow the Scottish Ministers to direct the Agency to refuse to exercise any further official controls at given premises where, despite a Court order requiring the operator of the premises to pay the official controls charge for which the operator is liable, that operator fails to comply with the order (regulation 4);</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(d)</num><p>require persons–</p><blockContainer ukl:Name="P4" class="para2"><num>(i)</num><p>to supply the Agency on demand with such information as it may reasonably require for the purpose of calculating the official controls charge or notifying the operator of it, and</p></blockContainer><blockContainer ukl:Name="P4" class="para2"><num>(ii)</num><p>to supply the Agency on demand with such evidence as it may reasonably require to verify that information (regulation 5(1));</p></blockContainer></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(e)</num><p>provide that a person who–</p><blockContainer ukl:Name="P4" class="para2"><num>(i)</num><p>in response to a demand for information or evidence knowingly or recklessly furnishes false or misleading information, or</p></blockContainer><blockContainer ukl:Name="P4" class="para2"><num>(ii)</num><p/></blockContainer><blockContainer ukl:Name="P4" class="para2"><num>(iii)</num><p>without reasonable excuse fails to comply within a reasonable time with a demand for information or evidence,</p></blockContainer><p>is guilty of an offence (regulation 5(2));</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><p>Schedule 2 to these Regulations sets out how the official controls charge is to be calculated.</p></blockContainer><blockContainer ukl:Name="P"><p>No regulatory impact assessment has been produced for these Regulations as they have no impact on costs of business.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
