The Scottish Ministers, in exercise of the powers conferred by sections 100(3)(a) and 275(8) of the Town and Country Planning (Scotland) Act 1997(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Town and Country Planning (Limit of Annual Value) (Scotland) Order 2005 and shall come into force on 19th December 2005.

Limit of Annual Value

2.  The amount prescribed for the purposes of section 100(3)(a) of the Town and Country Planning (Scotland) Act 1997 is £28,000.

Revocation

3.  The Town and Country Planning (Limit of Annual Value) (Scotland) Order 2001(2) is hereby revoked.

Explanatory Note

(This note is not part of the Order)

This Order prescribes £28,000 as the limit of annual value for the purposes of section 100(3)(a) of the Town and Country Planning (Scotland) Act 1997 (which relates to the circumstances in which authorities may be obliged to purchase interests of owner-occupiers affected by planning proposals) and replaces the limit of £24,725 prescribed by the Town and Country Planning (Limit of Annual Value) (Scotland) Order 2001 (which is itself revoked).
