The Scottish Ministers, in exercise of the powers conferred by sections 72 and 81(2) of the Transport (Scotland) Act 2001(1), and of all other powers enabling them in that behalf, hereby make the following Regulations:
1. These Regulations may be cited as the Mobility and Access Committee for Scotland Amendment Regulations 2005 and shall come into force on 19th December 2005.
2. The Mobility and Access Committee for Scotland Regulations 2002(2) are amended as follows.
3. In regulation 1 (citation, commencement and interpretation) after the definition of “the committee” insert–
““financial year” means the 12 months ending with 31st March”.
4. In regulation 9 (work programme)–
(a)for “30th November” substitute “31st March”; and
(b)for “calendar” substitute “financial”.
5. In regulation 10 (reports to the Scottish Ministers)–
(a)for “28th February” substitute “30th June”; and
(b)for “calendar” substitute “financial”.

These regulations make amendments to the Mobility and Access Committee for Scotland Regulations 2002 (“the 2002 Regulations”) which established the Mobility and Access Committee for Scotland (“the Committee”).
Regulation 3 amends regulation 1 of the 2002 Regulations to insert a definition of “financial year”.
Regulation 4 amends regulation 9 of the 2002 Regulations with the effect that the Committee is under a duty to prepare and publish, by no later than 31st March in each year, a proposed work programme for the next following financial year.
Regulation 5 amends regulation 10 of the 2002 Regulations with the effect that the Committee is under a duty to prepare and submit to the Scottish Ministers by 30th June each year a report for the previous financial year.
