The Scottish Ministers, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation and commencementS

1.  These Regulations may be cited as the Plant Health Fees (Scotland) Amendment Regulations 2005 and shall come into force on 5th December 2005.

Amendment to the Plant Health Fees (Scotland) Regulations 1996S

2.  For Schedule 2 (fees in respect of licensing services) to the Plant Health Fees (Scotland) Regulations 1996(2) substitute Schedule 2 as contained in the Schedule to these Regulations.

The fees shown in column 3 are the fees that were payable in terms of regulation 4 and Schedule 2 to these Regulations prior to the coming into force of the Plant Health Fees (Scotland) Amendment Regulations 2005 (S.S.I. 2005/555).

1.  Consideration of an application for the issue of a licence and the performance of any connected service, including the issue of a licence for articles imported for the following purposes–

(a)scientific

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which come into force on 5th December 2005, increase certain fees in respect of licensing services chargeable under regulation 4 and Schedule 2 to the Plant Health Fees (Scotland) Regulations 1996 (regulation 2).

A Regulatory Impact Assessment has been prepared in respect of these Regulations and copies may be obtained from SEERAD, Pentland House, 47 Robb’s Loan, Edinburgh EH14 1TY.
