The Public Appointments and Public Bodies etc. (Scotland) Act 2003 (Amendment of Specified Authorities) Order 2005

The Scottish Ministers, in exercise of the powers conferred by section 3(2) of the Public Appointments and Public Bodies etc. (Scotland) Act 20031 and of all other powers enabling them in that behalf, hereby make the following Order, a draft of which has, in accordance with section 18(4) of that Act, been laid before and approved by resolution of the Scottish Parliament:

Citation and commencement1.

This Order may be cited as the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (Amendment of Specified Authorities) Order 2005 and shall come into force on the day after the day on which it is made.

Amendment of list of specified authorities2.

(1)

Schedule 2 to the Public Appointments and Public Bodies etc. (Scotland) Act 2003 shall be amended in accordance with the following paragraphs.

(2)

Omit “Water Industry Commissioner for Scotland”.

(3)

In the listing of the specified authorities, under the heading “Executive Bodies”–

(a)

insert, at the appropriate place–

  • “Risk Management Authority”; and

  • “Scottish University for Industry”; and

(b)

omit–

  • “Scottish Further Education Funding Council”;

  • “Scottish Higher Education Funding Council”; and

  • “Parole Board for Scotland”.

(4)

In that listing, under the heading “Advisory Bodies”–

(a)

insert, at the appropriate place, “Architecture and Design Scotland”; and

(b)

omit–

  • “Royal Fine Art Commission for Scotland”; and

  • “Central Advisory Committee on Justices of the Peace (Scotland)”.

(5)

In that listing, under the heading “National Health Service Bodies”, omit–

  • “Common Services Agency for the Scottish Health Service”; and

  • “any National Health Service trust”.

(6)

At the end insert–

“Other Public Bodies

  • Parole Board for Scotland”.
