The Fire (Scotland) Act 2005 (Relevant Premises) Regulations 2005
Citation and commencement1.
These Regulations may be cited as the Fire (Scotland) Act 2005 (Relevant Premises) Regulations 2005 and shall come into force on the day after the day on which they are made.
Amendment of the Fire (Scotland) Act 20052.
In section 78(2) of the Fire (Scotland) Act 2005 (premises which are not “relevant premises” for purposes of Part 3)–
(a)
in paragraph (b) omit “construction sites,”; and
(b)
omit paragraph (c).

These Regulations modify the definition of relevant premises in section 78 of the Fire (Scotland) Act 2005 by deleting the reference to construction sites in subsection (2)(b) and deleting subsection (2)(c). The effect of this is that, subject to the provisions of section 78(3), (6) and (7) of the 2005 Act, construction sites and premises which on 1st July 1999 were of a description specified in Part I of Schedule 1 to the Fire Certificates (Special Premises) Regulations 1976 (S.I. 1976/2003) are relevant premises for the purposes of Part 3 of the 2005 Act.
